Timeline

My husband and I got our I-130 approved in Oct. 2019 and our case was sent to NVC in Nov. 2019  My husband came to visit me in the USA a couple months ago and then the whole coronavirus stuff happened, so we decided to do AOS instead.  It was my assumption that NVC would send our case to USCIS upon filing the AOS.  However, today we got notifications that we are documentarily qualified at NVC, so I called USCIS and talked to a Tier 2 Officer that says that we need to fill out an I-824 to get our I-130 sent back to USCIS.  I noticed there is a $465 filing fee to file the I-824!!  Has anyone else had this experience??

Omg! This is the first time I hear this. We just abandoned our Consular process of immigrant visa (our documents are in the US Embassy) and when filed AOS, we just added a copy of approved I-130.

I824 isn’t needed in your case. USCIS won’t request your file from NVC unless they start reviewing your file which could be months away from the receipt date, so just need to wait. In the mean time you can let NVC know that you are going with AOS with USCIS.

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
