Timeline

Can someone tell me if the Care Act applies to K1 Visas?

 

Title XX – Immigration Matters Sec. XX1. Extension of Filing and Other Deadlines. This section creates protections for certain noncitizens in the United States, as well as certain immigrant visa applicants, affected by processing delays and travel restrictions related to the COVID-19 public health emergency. Certain noncitizens who were lawfully present in the United States when HHS declared a public health emergency are protected from negative immigration consequences due to the inability to meet filing deadlines or leave the country. Temporary immigration status or work authorization that is set to expire during the emergency is automatically extended for a temporary period. Expiration dates of issued immigrant visas are extended for the duration of the emergency. Immigrant visa numbers that go unused at the end of the fiscal year are rolled over for use in subsequent fiscal years. And voluntary departure deadlines are extended for the duration of the emergency.

@praisejourney Your timeline states you have received a positive response at your interview that you were approved. Currently what does your CEAC status state. Do you have the visa in your hands? 

 

Even with your visa PH is locked down for travelers. You may want to join over in the PH sub-forum where they are discussing pathways such as yours.

This is the House proposed Heros Act.  A 90 page summary based on 1800 pages of proposed legislation.  None of it applies right now and it won't all end up that way it is written now.

Visa has a status of issued but not received yet do to the lockdown. We are hoping and praying we will get it by June 1st.  Ours expires on August 25th.

Then you need to check with 2Go to see if they have a record of it being shipped and it's in their hands waiting to be delivered to you. Go to @Hank_ site and look for the 2go contact numbers and procedure. He has outlined it well there.

CARES will have nothing to do with your question. Everything for you is now dependent on USEM. Your visa will have an expiration date of 6 months (maybe as most do) so once they open up or you find the visa you should be ready with bags packed to get out of the PH before it expires or new interview, new visa fee and new medical.

Consulates can  alredate do that for upto one year of the I-797 issue date.
