Waiver of Meeting in Person

Timeline

So I can not yet go to my girlfriends country for the necessary K-1 Meeting in Person within two years of filing the petition due to the COVID travel restrictions.

 

What do you think is the possibility of using that as a means of having a waiver of those requirements granted?    Impossible, very slim or barely maybe?

 

We have tons of other evidences of relationship growth and immigration to the US with the purposes of adjusting status and staying married.

You can ask.  It is usually done if there are religious or culture reason.   You can file, pay the fee, and wait to see if the petition is denied.   Don't expect the consulate to be willing to approve if those reasons are used.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Nil

 

By the time such a waiver request would be reviewed and decided upon, it will be months and you will likely have had a chance to travel several times over.

I've seen only a small handful of cases ever get that waiver approved. Temporary travel restrictions are almost certainly not going to cut it. They're going to want to see long-term causes of being unable to see each other.

Near-impossible IMO.

Slim! and he just left town.

 

You will most likely be wasting your time as USCIS does not hand out waivers for COVID-19 or everyone would be applying. I'm sorry you are caught in the middle, but you are going to need to meet in person. It's just what USCIS requires.

If it’s a fresh relationship, as others have said, you can meet and then petition after the restrictions are lifted. There’s a reason they gave that long 2 year period.

We only met at the end of last year and when beginning to plan my travel to meet with her, COVID kicked in world-wide.

 

I understand totally and appreciate your opinions; which also echo mine.

Last year, as in 2019?  Then you still have lots of time.  And the more time you have together (face to face) before the consulate stage the better!    For USCIS it only takes 1 meeting.

Last I checked there isn’t been a travel ban for 2 years. You say you have “

but “tons” of conversations doesn’t convey a relationship. It’s also strange to talk about AOS planning to stay married as “proof”..doesn’t everyone Plan to stay married- otherwise why waste the other persons time.

 

My advice- wait to file until you meet. Do you really want to spend the rest of your life with someone you’ve never met? Immigration issue aside.

Especially when day in, day out, we see stories of people complaining that their significant other "changed completely" after moving to the US........ 

 

Take your time to really know who you are planning to marry. By law, you could petition anyone within a day of meeting them, but that doesn't mean it's what you should do.

Definitely wait until you meet before you file! You want to make sure you feel the same way in person as you do long distance before taking on the time and financial burden of the visa process!

Slim to no chance of waiving the meeting requirement.
