Hi, All

We decided not to move the process further even though we were approved for I-129F and I-130 on May 24, 2007 and my wife received packet 3 on June 18, 2007 in Japan.

The reason is as follows:

I am a Japanese also having a US citizenship because I was born in the US. I came to California to study at a graduate school with my US passport. Because of this, my wife (Japanese) could not get a F2 visa (dependent visa of student) like other foreign students and therefore we had to go through the immigration visa process.

We were planning to apply DCF in early February 2007, but as many of you experienced, the Adam Walsh Child Protection and Safety Act implemented in the end of January 2007 destroyed our plan (before we could get immigration visa in about 1 or 2 months through DCF). Although the embassy in Tokyo restarted to accept I-130 petition at the embassy, they limited the eligibility to a citizen residing in Japan for 6 month before filing. Although I am Japanese and have lived for more than 30 years in Japan, I am now living in Califorinia and not eligible for DCF.

Anyway, we went along with the K-3 process and got an approval in May and received packet 3 recently, but it was too slow. If we go through the interview process of K3, the interview will probably scheduled in the end of July or early August and my wife can come to the US in mid August at the earliest. But that is too late. I had a job offer in the UK and going to the UK from September, leaving the US in late August. I already obtained UK workpermit and going to get the UK visa this week. My wife will also get the visa in Japan, soon. Then there is no reason for her to stay in Japan. She can come to the US with a visa waiver program because it is less than 90 days until the day we are leaving the US. There is of course a risk for her to come to the US with a visa waiver program but she should have an endorsement of the UK visa on her passport and can explain to the port control officer that she is not staying the US for long (she will come with a round trip ticket). If the processs were a month earlier, we might completed the K-3 process, but after considering every possible scenario, we decided not to move the K-3 process further.

I want to thank all you guys in VJ. I learned many people from many countries are struggling with the same problem. Somebody's word encouraged me when I was so stressed. I was very happy when somebody was approved. Reading forums became my daily habit.

Now I am stopping my process but I will come to see the forums sometimes. I hope my timeline become one of useful precedents. Hoping everyone's early approval. Good luck and thank you!

03/12/2007-Found typo in NOA1. Also found that Received Date and Notice Date are blank. Called USCIS. Because information on the system was correct, did not asked to resend NOA.

Hi Taka,

I am a Japanese who have been married to American for 11 years , and am in the middle of processing to get a green Card as well.

We have two children and currently they have dual citizenship, US and Japan.

But in Japanese law, when my children become 21 years old, they have to choose either one of the citizenship.

Because Japan doesn't allow to have dual citizenship.

There is a question.

As I read your post, you are already over 30 years old. How do you keep dual citizenship Japan and US ?

I love my kids to have dual citizenship in the future, but currently there is not way to do that legally as far as I know..

I love to have a US citizenship in the future as well if I can keep Japanese citizenship, because I can live in Japan and in US anytime..

I have a green card, but my husband got a job in UK, and we all stayed there over 5 years, so my green card is no longer useable. Now I with my kids and my husband are separated for more than 6 months to apply for the green card again...

I really appreciate if you can advise me on this..
