Hi everyone good day to all, here's my problem my in-laws who are in their 70s came here last November 27 on a B-2 visa and they were supposed to return home on May 21 but since this virus every flight home was cancelled I've tried to get them a flight home back in March but to no avail so I'm trying to get them a extension but I can't get the I-94 from CBP since their passport was never stamped on arrival I've been emailing and filing out the form online but it says no record found I've been talking to USCIS and I'm told not to worry about it I don't want them to over stay

No since PAL AIRLINES cancelled all their flights with no rebooking in sight. But they said once they're able to fly again I can rebook anytime

I can't since CBP can't find their I-94 . They never got a stamp in their passport on arrival and every time I inquired on the I-94 site it says no record found so they'll just have to wait it out

Teddy,

Have you actually spoken to CBP?  Are you aware of Deferred Inspection? https://www.cbp.gov/contact/ports/deferred-inspection-sites

I'm not 100% sure if they'll help with a *missing*/*not present* I-94, but I'd still try to contact your nearest Deferred Inspection site to see what they can do.  There are email/phone contacts above, and the following (seemingly new CBP) contact form info seems like a good place to try as well: https://help.cbp.gov/s/article/Article-1696?language=en_US

There is no need to talk to CBP to get a copy of their I94, they have stopped stamping passports fora whilenow and everything is electronic. Go to this web site https://i94.cbp.dhs.gov/I94/#/home

with their passport handy and the specific date they entered the US and you should be able to easily retrieve their I94. I did it last werk for my Mother in Law.

them you need to file I-539 for each of them for the extension of stay.

05/25/2018: EAD approval letter received in Mail

05/29/2018: EAD card and letter for interview (Jun.26th) both received in Mail, Woot woot :)

06/26/2018: Interview completed, now waiting for the magical email/letter...

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

Have your in-laws contacted the Philippines embassy? They should be working to help bring their citizens home. USCIS isn't going to care you can't find their I-94. They are going to be out of status and most likely lose their ability to ever visit again. If they wanted to live here your wife could have applied for a visa for them or they can adjust status providing you can show $$$ support for 2 70 year olds.

I finally got someone on the phone at CBP and I explained my situation and he sent me a email back with a case number now I have to upload my in-laws information and hopefully get a response
