Hello,

 

I am new here. 

I am planning to file K1 Visa for my fiancee next year but i have some questions that really bothers me. I hope you guys can enlighten me on a way.

 

I stayed in Philippines since I was an infant but I was being here in the US. My mom did not apply me for a dual citizenship and no one knew about it since I was left in the province. When I decided to come back here in US, I just found out that I have taxes for overstaying roughly $8k to be exact. They decided to deport me and I can only come back if I do have the money to pay for it. 

 

Will this affect or will make a hindrance if I file my k1 visa for my fiance? Will this be brought up or will it make our visa application denied? I'm worried.

You are not applying for a visa.  Your immigration history has no effect on someone else's journey

1. How do you know you are a US citizen? were you born in the US?

2. If you are a citizen by birth and can prove it ,never heard of a US citizen deported

3. How did you get on a flight to US?

4. Your Mother did not apply for dual citizenship? How did she manage to take you to the Philippines ?

5. If all is true, your fiancee's immigration journey is separate, you will prove that you can support her or she can support herself by filling I-134 after your petition is approved by USCIS

6. You will need to provide prove of your citizenship to be able to file I-129f for her.

Hi! 

 

1. I was born here in the US 

 

2. my mom left me in PH When I was only 2 years old. She didn't apply for dual citizenship for me not advise those who adopted me in PH on what to do with my case. 

 

3. After 23 years, I decided I need to go back where I was being for my kids as well. Then that's the time I learned about my taxes and I was overstaying the whole time. I did not know since I live in the province as well. Its either i pay the 8k or i get deported. I don't have any money on me so I got deported and was advised that I can return if and only if I pay the taxes. 

 

4. I'm not sure about this but she just took a flight maybe for vacation before then that's about it

2. Usually you need a US passport /Birth certificate or a Filipino passport with a valid visa to get on a flight to or out of US

3. Overstaying where? in the Philippines ? its not a problem for US if its citizen overstays in another country

4. Does it mean you lived in Philippines all this while without a US passport or a Filipino passport?

5. To prevent child trafficking even day old infants or children and adults, are required to have a valid passport/Birth certificate or requisite visas when traveling internationally
