I-130 petition for alien relative

hi! My mom is the petitoner. The beneficiary is my brother who is more than 21 y.o and single. The USCIS requested RFE because my brother's BC was registered late. For those who requested for DNA Test, how did you do it if the petitioner is in the U.S and the beneficiary is in the Philippines. And also we needed more evidence to prove their biological relationship. Please advise us. Thank you. Keep safe.

You find an AABB accredited lab in both places.  Follow the instructions under DNA Testing.

Is this dna testing a must? My mother's understanding is if she cannot get sexondary evidence then she have to do the dna.. thanks for your response anyway..

Must? No. However we have seen denials when it was not provided and the secondary evidence was deemed insufficient. Do not expect USCIS to RFE twice for the same issue...make sure the response is complete because you may not get a second chance (Well, the RFE is the second chance...so don't expect a third chance).

It’s not a must ( that’s why you are “encouraged” in the letter rather than told to do it), but it is the clearest and most irrefutable evidence you will have. And yes if there is no other secondary evidence then it’s the only route you have really.

 

Edit: reading the full letter to see what you are required to submit in addition to secondary evidence, honestly, I’d just do the test. Not cheap but quick and easy and you proactively  circumvent any issues of them not finding the evidence for late BC  “credible and probative”.

Cost springs to mind. Ours cost $500, and that was with both parent and child in the US, I imagine having one party outside the US makes it more expensive.

Best to do the test and not have to do an appeal or refile.  DNA will be conclusive proof.

I just called the dna testing accredited by the uscis. It will cost us $680 then P1500 in the philippines. Thanks for all your response. I will take your advice and proceed with the testing.
