Another stimulus question

Hi all, hoping some of you may be able to advise or give opinions on stimulus eligibility for myself and my wife.

We gained our green cards through the diversity lottery- our LPR cards were issued in August of 2019 which is when we activated the passport printed visa- although we didnt physically move to the US until January of 2020.

I am considering applying via non filers but obviously don't want to mis step.

We both have SSN and are considered residents since August 2019, however as part of the diversity process we had to meet the public charge criteria and show we could fend for ourselves etc- am I overthinking it or could applying for the stimulus be seen to be a 'breach' in that sense that could come back to bite us?

Many thanks all- stay safe

Stimulus as in the $1200?  You said you activated the green cards, by entering the US?   If you were considered residents I guess you can try.  It isn't a public charge / benefit.  Otherwise when you file 2020 taxes you can get the credits.

@Damo24

You can read this page from the USCIS Policy Manual https://www.uscis.gov/policy-manual/volume-8-part-g-chapter-10

It’s a long page spelling out what is and isn’t considered public charge. It you scroll way down you will find
B. Public Benefits Not Considered

Then further below that—

Other benefits not considered public benefits in the public charge inadmissibility determination include, but are not limited to:

In that list it says Tax Credits

The payments are a 2020 tax credit that they are handing out early. You are eligible and it does not affect your public charge admissibility.

If you became a permanent resident in 2019 then when you filed your 2019 taxes and declared your worldwide income in 2020 you should have been processed for your stimulus.

Thank you for your helpful replies- it seems my approach to this was wrong in thinking I could apply via 'non filers' as I had $0 US income in 2019, having only physically arrived in January 2020

If I'm now understanding correctly, I actually need to file a 2019 tax return for income earned in the UK for the 4.5 months that I was considered LPR (green card issued mid August 2019)

Or it will be paid to you as a credit when you file 2020 taxes in 2021
