Replacement GC within application period for condition removal

Hello all,

 

I had my wallet stolen about a month ago. In it of course was my GC. (Never doing that again)

 

I filed my application to have my conditions removed from my 2yrGC last November (2019). I had my biometrics in January.

 

If I do an application for a replacement Green Card it will take 12 months, possibly longer now. Not to mention costing me $550. Either way I won't have a physical GC when the time comes to possibly have my interview for my 10yr GC. I'm also technically eligible to apply for naturalization in November. 

 

All my process so far has been very smooth and painless, albeit lengthly. Now I'm genuinely concerned about what to do.

 

What do I do???

Timeline

The 2 year GC is not renewable, and your extension letter will invalid without that 2 year GC. Try to contact USCIS to see if you can get the stamp since you will need it to travel in the future.

I have already filed the application to have the 2year GC conditions changed to the 10 year. I'm not trying to renew it.

There is no replacement for 2 year GC. You already filed for ROC, but you will not able to travel since you lost the 2 year GC and the extension letter will become invalid without 2 year GC. If you want to travel, get the stamp from USCIS. There is no new GC until your ROC approved.

Did you have it on you because it's required per INA 264(e)*? If so, when you get the 10 year GC you can carry a paper photocopy with the front and back of the card as a compromise, since losing the GC is a headache.

 

*INA 264(e): "Every alien, eighteen years of age and over, shall at all times carry with him and have in his personal possession any certificate of alien registration or alien registration receipt card issued to him pursuant to subsection (d). Any alien who fails to comply with the provisions of this subsection shall be guilty of a misdemeanor and shall upon conviction for each offense be fined not to exceed $100 or be imprisoned not more than thirty days, or both."

You are trying to renew/replace it, which is not possible within the 90-day period before it expires or after it expires. You can't file an I-90 in those circumstances.

You should get the ADIT stamp.
