well, they have a point I guess, you even said before it’s your choice to stay. Question: is it possible for you to make a return trip to the US before your year is up, then go back to France?

Yup, as a green card holder you are required to declare your worldwide income on your IRS tax return regardless where it was earned or where you were when you earned it. I’d suggest correcting the tax return. That’s a potential problem both for keeping your green card and for if you want to naturalize.

I’m not sure he did it, we didn’t know. 
would it be a problem if I reapply for a immigrant visa IR1? 
because the embassy told me I’d not qualify and I can’t go back before September.

April 6,2023 Legally Separated - Oh well

Yes that’s what I meant! And okay, I’ll send my green card with the form to USCIS. My embassy doesn’t receive them anymore

Yeah, you do know.  It’s written on every document outlining the requirements to maintain your card.  Failure to file your taxes and worldwide income would get an SB1 denied anyway.  First thing they verify.

 

We turned in a green card in 2010 and filed a new petition in 2011 and it went smoothly.  Good luck

I’m confused as they say the I407 is only if I don’t ask for an immigrant visa in the future and that I need to go through the SB1 before applying for anything else

I decided to leave before the one year mark to be sure to be able to get in and not have problems. Even tho I know they’ll take me for an interview at POE. 
however the price of the one way ticket is just TOO expensive! 5370€ for my daughter and myself. I know a one way ticket is the best, but would it be a problem if I take a round trip ticket with the second ticket maybe a year later? 🙄 can’t believe how expensive it is!

Not an issue at all....period.........just buy the least expensive one.......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I read that they could tell me I abandoned the green card even before the one year mark and the round trip ticket might be negative for me 🤷🏻‍♀️ But definitely less expensive by 3000€

Well that’s your answer if they ask why you have a round trip rather than a one way. Not the first person to do this because it’s cheaper on some airlines.
