hello people

im planning to petition my fiancee in the philippines very soon, but i have concerns about her being widowed and her marriage to her late husband was never registered (they had an islam marriage ceremony). also they had 2 minor kids which also uses their father's last name. being the marriage ceremony was never registered, my fiancee did not used her late husband's last name.

my question is.....would that raise red flags? or i just worry too much  HELP

thanks in advance

I see two choices.

1. File as if she was never married.

2. File as if she did marry the father of her children.

If you file as if she were married, you don't need a marriage certificate, just a death certificate.

I don't see why either would present any particular problem. What problem or difficulty did you consider?

If it was never a legal marriage then I do not think you have to even technically say that she was married despite her having klids. I was divorced on 12/19/07 and remarried on 01/25/07 and they honored our petition despite me getting divorced and married within a month. However, if there was something legally binding them even if it was through common law (I don't know if that is practiced in her country or not) then she may have to at least go through a legal separation. I mean, if there was paperwork involved.

The best thing you can do is have her apply to NSO for CENOMAR and see what they have on file.

File for kids NSO BCs also and see what they say.

Next is go to her LCR and see what they have on file also!

You CAN"T do anything until doing such!

While she doing it she should file for the NSO Death Certificate and her NSO BC also ! Get 3 copies of everything.

Local Civil Registrar in her area!

Sometimes the LCR will have records that the NSO main office [Quezon City] Doesn't have.

She may also have a NSO satelite office near her!

Everything such as births, deaths, marriages etc are first registered at the LCR. They forwarded them [suppositely] to NSO Manila [Quezon City] for National recording!

For sure have her check her BC for being correct and late registration. LOTS of mistakes on Philippine BCs plus LOTS of late registered do to the use of midwifes {Hilot}.

Hopefuly she is from Luzon. Makes it a LOT easier for EVERYTHING thru out the process.

Hint! You can order NSO certified copies online but it takes awhile and isn't cheap.

http://www.gov.ph/faqs/civilregistration.asp

Better if she does it there. I think I paid 20 USD for each online!
