The Supreme Court unanimously upheld a federal statute that outlaws encouraging illegal aliens to remain in the U.S. unlawfully in a decision Thursday. This is from a 10 year old case.  The case involves a woman who coached Illegals how to skirt the system and stay in the US.  She made over $3 million for her services.  Now that the SG ruled and the US Federal law stays, I wonder if City Counsels,   County Boards, and  State Legislators / Governors  who protect illegals with Sanctuary laws will be arrested at some point, or forced to deny sanctuary.  Something to keep an eye on.

 

Granted, the SG ruled on the appeal for the Ninth District, who relied on a "Friend of the Court" in their decision is why the SG tossed it, not so much because they felt is was "wrong" but more a procedural problem.

Actually, I am not sure that SCOTUS ruled on the merits, they just vacated the decision of the 9th Circuit and sent it back to them.  It will take a little more time to see the final outcome as the 9th rehears the case, but of course the makeup of that Court has changed a bit since their original ruling, so maybe the outcome will be different.

It really tells you how unbelievable the 9th circuit has become, where they feel that entitled to shape policies that aren't even being argued before them. While I'm likely not a fan of the people Trump will flood the 9th with, it certainly needs more diversity, but more importantly, a reminder of its purpose in the form of a gut check. Courts decide cases, they don't create policy. The belief that they do is what leads to the view that Roe v. Wade is law and must be adhered to when in fact it can be reversed at any time. Similarly, the same group believe that local governments can inject themselves into policy decisions for what's clearly the federal government's domain, which is immigration. Immigration was never delegated to the states, counties, or cities to decide. The discarding of very clear rules the Constitution describes has helped set up the current form of chaos (and corruption) we've been experiencing.
