Petitioner got laid-off while waiting for interview for beneficiary

Quick Question, with the covid-19 going on, many people are laid-off from jobs, imagine Mr X filed a petition and all is approved waiting for interview as of today. however before the interview date, Mr X got laid-off. Will that be an issue during the interview. Note. He had a full time job in 2019, and his I-864 was approved base on 2019 income. Someone sent me a Private message , however I have no idea.

CO will decide based on current income at interview time, not income in the past. Consider looking for a joint sponsor.

Do one have to upload the joint sponsor with the NVC or joint have a hard copy (Joint Sponsor)  and submit it during the interview ?

If you’re already done with NVC - DQ - then you’d bring it to the interview. If not DQ, you want to update your I-864 and add joint sponsor.

In theory...the existing I-864 reviewed by NVC is still valid. There is no requirement to provide a new one due to a change in circumstances. it was accurate at the time of filing.

In practice...the CO may want to see an updated one, especially if they discover a change in circumstances (like becoming unemployed). It would be more common than uncommon, IMHO, to be asked a question about the petitioner's employment or if there are updates to any forms or information.

 

I would suggest having an updated I-864 packet - plus that from a joint sponsor - prepared for the interview. No need to upload it to NVC - the CO can review it at the interview.
