:help:AOS Pending for background check. Had interview 4/17/06 everything ok except background pending. Its been since 10/18/05 since filed AOS. Going to apply for 3 EAD now. Has anyone been in a background check this long? Ordered three service requests now basically says the same thing background checking. Please Respond

I'm not an expert but there is no way a background check takes that long. There has to be something else going on. You must be a very patient person. I would have contacted my U.S. Senator a long time ago.

2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

I can't say too much as I might say something that I shouldn't but let's just say I work for and know people involved in background checks and yes they are FBI checks and nobody has ever waited 2 years for their check. It just doesn't happen. There are other reasons other than the background check why somone's cases hasn't been approved.

Well it would be helpful to others here if you could elaborate just a little further. There are people here who have been waiting 1+ years or more who are AOS approved "pending background checks" (people who already when through some of the immigration process and came in on a K1 or a K3).

If it's not background checks, then what is it? Even the ombudsman says that background checks have been delaying cases for a long time..

"Background checks may still be considered pending when either the FBI or relevant agency has not provided the final response to the background check or when the FBI or agency has provided a response, but the response requires further investigation or review by the agency or USCIS. Resolving pending cases is time-consuming and labor-intensive; some cases legitimately take months or even several years to resolve. Every USCIS District Office performs regular reviews of the pending caseload to determine when cases have cleared and are ready to be decided. USCIS does not share information about the records match or the nature or status of any investigation with applicants or their representatives."

Even if one appeals using Freedom of Info Act, USCIS simply would not disclose anything classified. I know of a friend years ago who waited 3.5 years, got the senators etc involved (they did help but only to a certain point---that was how they learnt they were stuck in FBI name checks. His family gave up and moved out of the US to another country. Unfortunately.
