I-864EZ & Income Change

Due to COVID-19 and business downturn, it's looking like I need to take a pay cut: 

 

25% cut for 6 months, then a return to full pay.

 

So taking that my current salary is 12 months going forward from the date I sign the form, what would be the better way to report the above? 

Could I show this an average 12.5% pay cut for the 12 month?

 

I'm employed and meeting the FPL is not an issue with the cut.

Current income is current income - it's what you make at the time of completing the form. If somebody was laid off today, their current income would be $0. If they are hired tomorrow at $50k/year, then $50k/year would be their current income.

You can bring an updated I-864 to the interview, such as if there is a change.

“Looking like” is not actual. Sign the form with whatever you make now. Actually, put something you can easily prove on paper to the NVC like whatever your tax return says or you can get in an employer letter. Don’t make them have to get out a calculator and follow some method you write that isn’t clearly on paper from the boss, IRS, or paystubs.  London won’t be bothered but it’s getting past NVC who is checking paperwork.

The 'looking like' is factual, so the figure that I need to use. My tax return won't help, as this is what I did earn and not what I will earn for the 12 months of signing the form. Pay stubs will just show a salary that is 25% less then what I earned last year, although this will be for 6 months as I mentioned. So a letter of explanation from my employer and upload this to NVC?

And what about the thousands who use their tax return? How can anybody prove the future on paper? Maybe you lose the job. Maybe the cut lasts eight months.  If you are over the poverty line, then prove that on paper. They do to need to know your exact income from sometime in the future. If I had a million dollars, I only need to prove $22,500, so wouldn’t get into some convoluted letter of explanation. Provide something that shows that TODAY you make over the poverty line without adding “but in six months I will make more” is the only practical advice I have to offer. Suit yourself how you choose to show the NVC

Then that is a simple resolution, at the most minimal level, i'll exceed $22,500. so will take a pay stub, (with the 25% cut) and multiply by 12.

 

The CURRENT income is what they need to know, unless anyone else has an opinion? My 2019 tax transcript proves no issue with earned income from the PAST...
