Spousal visa I-130 USCIS requirement

Hey

You don't need to submit your marriage photos to USCIS. When i filed i only submited my marriage certificate and they did not ask me for any evidence.

You haven't had your interview yet.  That is typically where it gets tricky for Islamabad, which is why some choose to 'front-load' their petitions at USCIS.

I don’t see why others are coming off mean or rude to you, but to be honest I hired a lawyer and we did not send photos or passport tickets for bonefide marriage, he told me that we’ll need it at the next stage..now I did receive a RFE, it was not for not sending proof of real marriage, but because I sent a copy of my abstract birth certificate and not my certified birth certificate, the original. Now USCIS is obviously inconsistent with the processing of the applications, so I say wait and see how everything goes. If you do get a RFE just give them EVERYTHING they ask for since that’ll be your only chance to move forward. And it’s okay to ask the question twice. This platform was created so that we help and support one another through this, don’t let one person or two ruin that for you. Good luck!

No one is being rude, we're being realistic with experience. If the OP doesnt get an RFE we will all cheer. 

 

The CO doesnt need to look at any evidence you bring to interview. For high fraud countries it's important to front load and even side load your petition and application.  We're not paid.  We don't get money to make things take longer. We don't get money to help. We do this to help others get through an emotionally difficult process as easy as possible with experience gained by the forum as a whole. 

But advice is a dime a dozen and you never have to take it.  That doesnt mean anyone is malicious and wants anyone to fail. Quite the opposite.

Administrative Processing can last for many months (even years).  It can not be expedited.  Pakistan cases are frequently delayed due to lengthy background checks.  Remember that visas are not approved until all checks and processing actions have been done after the interview.......Hopefully, your case will proceed without extended delays.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There are cases where front loading a petition is advantageous.   But none of that matters to USCIS.  USCIS is looking to see if the parties are eligible to for the benefit being applied for.   Check the boxes and the petition will move on.  The facts are the facts.   NVC operates the same way - file the documents and show the minimum financial support and the petition will move on. 

 

Get to the consulate and things change.  The CO will take a few moments to look at the file before the interview.  The CO can consider many things.  Certain consulates are more difficult, like ISL and Morocco.  If you are from a country on the bottom 10% of the Passport Index expect it to be a rough ride. Are there red flags, like age gap, different religions, or where other cultural norms were not completed by the parties. Age and health conditions.  Will the beneficiary potentially be a public charge?  They are not required to look at or consider any documentation you bring in.  They can tell you they are recommending your visa for approval.  They don't actually approve you as the file is then again reviewed and security check are done.

 

So in some cases it is best to front load in the original petition with as much primary and secondary evidence as you can. Passport stamps, multiple trips, multiple charges on a credit card in country are best.  Pictures together, chat logs, boardings passes are secondary evidence.  

 

Immigration firms come in many types.   Most big firms are doing work based visas.  H1/H2/L/O is where the (easy) money is made. They tend not to do a lot of initial family visas.  Family visas take a lot of time to do right, have lots of emotion and there is a lot of hand holding that gets done.  Ironically most family visas are the easiest DYI.   

 

Do you have a good attorney?  I don't know.  Their yelp review is about half O-1 visas.  It boils down to if you think they did a good job filling out the forms.

 

I doubt there is going to be an issue with the USCIS.  The consulate is where all the fun is!

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

thank you very much ....yes i think u can feel it .....and secind rfe delays the case for 2 to 3 months max or it takes more ....from your experience ....😊

I hired someone to put the petition together. Glad i did. 

Im not the paper petition type of person. It was very big and it still was work on our end. Flat rate and worth the money.

I don't get the negativity either.

I just file I 130 for my wife  and I sent scan of marriage license in the local language and English both of our passport , passport size photo , photo of our relationship, documents such as flight ticket, money transfer and our crba for our son.

Sorry for the late reply. I submitted my original nikah-nama and the translated version to the USCIS. But when you submit nikah-nama to the NVC you have to submit the original one, translated version and the nadra one.
