Hi

guys i am beneficiary of spousal visa filled by my wife i 130 she is american citizen .we filed our case on 20 may 2019 .we actually hired a attorny in newyork .Now my question is while filing our attorney didnt asked us for photos and other stuff to show bonefide marriage just submmited the marriage cerficate with local and english language now i heard few days back that u have send marriage photo and other stuff to uscis .so really worried are we going to have RFE or not.

There is no need to ask the same question twice, wait and you will get answers.

No one can tell you whether or not you'll get an rfe and if you do, just send in what they ask for.

Hiring a lawyer is nothing but a headache and a waste of money unless you have a complicated case.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I have a lawyer and at the first part of the process (uscis) they were really helpful but at the NVC stage it was a waste of money. they don't care if you get an RFE they will just tell you "if something is needed or rejected, we will provide then" yeah because they are not the one biting their nails. since you are at the USCIS stage just wait and see if you get one or not but I suggest you start searching for what you will need for the NVC stage starting now. NVC stage is pretty simple, I had to upload everything on my own and get the right documents on my own because lawyers are as lost as you are at the NVC stage because they don't have a clue about documents needed from your country and they don't read for updates or anything. That has been my personal experience with my lawyer, waste of money! Good luck

Sounds like a terrible lawyer.  You'll probably get an RFE if the lawyer at least submitted all the required documents.  If not you'll get denied and have to refile.

You said the lawyer asked for the marriage certificate and its translation only so how can he submit every requirement. Have you read the i130 instructions listing evidences of bonafide marriage? As said, RFE is likely.

no no he has submitted everything else but i am surprised that lawyers also dnt k ow what to submitt and what to not ...obvoiusly i  concerned that why he didnt sent our marrige photos and tickets .anyway its time to be positive ....lets hope for teh best

btw sir how much time el it require to resolve this rfe and imean how much delay

Expect delay by up to several months if you get the RFE.

Did a google search, found 3 lawyers with that name, none are immigration.   The one in NYC is a criminal white collar attorney.  Great if you commit fraud, not great for immigration.

I got an RFIE for a tax transcript instead of a tax return. They issued it almost immediately, I sent the transcript back the same day I received the RFIE in the mail, and about a week later they updated my status online to “RFIE received, case will resume processing.” An RFE is not the end of the world.
