Will I need a lawyer?

Timeline

UNFORTUNATELY I will be removing my conditions of my 2 years green card alone  .it expires in feb 2020.ive been doing alot of reading and found out I would have to apply for a waiver with the the divorce decree and evidence of a bonified marriage. Would it be best to use and attorney?were going through a mutual consent divorce. We really love each other but things have gotten soo toxic and we cannot be around each other without arguement so I had to move out and get a place of my own.

 

For my I 175 waiver package I will be able to provide 

*Copy of the lease from when we lived together 

*Evidence of a join savings account 

*2019 tax return filed as "married filing jointly "

*Copy of both of your drivers liscense showing same address 

***photos of us together after i migrated to America 

***copy of documents showing she was the main beneficiary on my work life insurance..

****affidavits from persons who knew us.

***copy of document showing we were on the same car insurance policy....

She said she will write an affidavit saying the marriage was in good faith (not sure if she will thou)

 

Is that enough evidence to remove with a waiver ? ,and should I start saving up to hire a lawyer?I honestly still do love her alot but this is for the best. Thanks in advance for the informative and helpful feedback. Wishing everyone safety during this pandemic

No you won’t need a lawyer. Lawyer can not do ANYTHING. You have enough documents and you still will fill the application. So what is the reason for lawyer big payment?

I was thinking because I'm using a waiver it would've been a more delicate situation,I will just read more on the process and get more familiar. Thank u

9/4/2019 - Packet was sent
9/6/2019 - Packet was received by USCIS in Phoenix, Arizona
9/11/2019 - Personal Check was deposited/cashed by USCIS
9/11/2019 - Received text message with my LIN case #
9/14/2019 - Received Receipt and Extension
1/10/2020 (Day 126) - Received Biometrics Letter
1/23/2020 (Day 139) - Biometrics Completed

2/8/2020  - Separated from Husband

8/11/2020 - Divorce was Finalized

9/10/2020 - New Card is Being Produced

9/14/2020 - New Card was Mailed

9/15/2020 - Post Office Picked Up the Card

9/16/2020 - Card Delivered

8/21/2022 - N-400 Form was Submitted and Case is Being Actively Reviewed

10/21/2022 - Interview scheduled

12/1/2022 - Interview and approved

12/1/2022 - Oath Ceremony Will Be Scheduled (30-45 days)

You don't need a lawyer. A lot of marriages break down, USCIS knows this hence the waiver option.

You have enough evidence, IMHO.

Once you have the divorce decree you can file for ROC, even if it is not February 2021 yet.
