Hey, I'm new on this thread kinda worried now....

Does anyone know what happens with the k1 holders? Are we banned too? I'm from Argentina and my visa expires soon 😥

Well with the way things are looking now I would say get here ASAp before it expires..

We just got our I-130 approval letter from the London Consulate. Dying to get our packet with the LDN number from IVU so we can get online and book hubby's interview. Thankfully we are looking to try and get it done around November, so there shouldn't (hopefully) be any issues. :)

I’ve been following this thread and a few others and I don’t think that email is stating that the K1 falls under the proclamation, I think it is stating that since the routine visa services are suspended they are ONLY processing those visas listed as they fall under the mission critical or emergency visas. I believe that one routine service begin again they will begin processing K1 visas.

Additionally. My fiancé was able to schedule an interview yesterday for August 7th.

That is exactly what I was saying. The proclamation has now expired though as the 60 days has passed and it has not been extended as far as I can see. So K1 should now be allowed to be processed and issued as the proclamation is no longer in effect.

The only proclamation that is still in effect for K1 is for TRAVELLING to the US and having been present in the UK in the last 14 days. This does not effect issuing of visas at the embassy in London though as far as I know.

I believe the EO expires at 11:59 tonight and he is set to announce another one sometime today but its said to be focusing on non-immigrant employment based visas, which shouldn’t apply to K1. If spousal CR/I-1 visas were exempt from the IV EO surely K-1 should also be exempt from the NIV one since K1 is basically the NIV equivalent of the spousal visa and doesn’t allow work until AOS which can take months/year territory 🤞🏻 If this is truly just to “save the economy” 🤷🏻‍♀️

Someone else on the thread had heard they will open at the end of July, but I wouldn’t take that to the bank given all the mixed info. I’ll believe it when I see it.

However, my fiancé was able to schedule a medical exam for July and an interview for August so that’s some light at the end of the tunnel hopefully.

I'd of thought they cant give exact dates etc.. also July appointments are available to book wouldn't they be blocked if they weren't opening? The way all this has been handled with next to no communication or clarity I don't have much faith in the embassy/consulates lol.

Yeah it’s really all hearsay at this point. We’re going to see if we can get any info out of the people at the medical office when we go!

The proclamation has been extended.  H-1B, H-2B, J, and L nonimmigrant visa programs are named as included.

“I have determined that the entry, through December 31, 2020, of certain aliens as immigrants and nonimmigrants would be detrimental to the interests of the United States.“

K1 is fine though?

It does not mention K1 as included, or as exempt.

The new proclamation says:

Quote

given the lack of sufficient alternative means to protect unemployed Americans from the threat of competition for scarce jobs from new lawful permanent residents, the considerations present in Proclamation 10014 remain.

The H-1B, H-2B, J, and L nonimmigrant visas are just added onto those listed as suspended in 10014. So it would seem that K1 cannot enter till at least December 2020.

K1s are not suspended. They are a non-immigrant visa (and not one of the non-immigrant visas specifically banned)

I understand that it is classified as a non-immigrant visa but when I login to ais.usvisa-info.com to book an appointment for K1 it makes me go to the immigrant visa section not non-immigrant.

Yes they are processed by the IV unit. But if you look up the definition of a K1 visa on the Department of States website, it is written into law as a non-immigrant visa. Processing style can’t change what it actually is
