Hello VisaJourney community,

after good news before, we now sadly have to ask a question that is bad.

We "sent" our AOS papers in January and never heard anything back, not even the electronic message.
Now it turns out, our papers never made it to their destination.

We know that waiting so long to take new action is bad,
we just got overwhelmed by the current corona situation...

Our question now is what we have to do, as we're out of status.

Some information that might be helpful:

1. We married within the 90 days - just like it was planned.
2. We married less than 6 months ago.
3. We have all papers that we sent the first time in copy.

Our questions:
1. What should we do now - can we just fill for AOS "again"?
2. My wife sadly got furloughed, but our joint sponsor is still working and doing great - will her furlough be a problem for us?
3. She didn't fill for unemployment benefits yet, out of fear that this will ruin our chances for the AOS, is this true or can she fill for unemployment?
4. I heard there were changes in the process in February - do they count for us too now?

Make sure you send thru trackable carrier this time like USPS priority mail or UPS/Fedex.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2016-05-16: N-400 NOA1

We will definitely use a trackable carrier this time!

We learned form our mistakes.
And we will do it ASAP, it'll be at the postal office tomorrow if possible!


Should we fill the forms out again with all new information, or use the old ones again (that now are outdated in some places?)
If I remember right, there was a question asking if there ever was an overstay - does this currently count as an overstay and what should we put for that question?

Forms have changed,  if you submit outdated forms you will get it all back

Almost every form got an update by February so you have to use the new ones. With all the required stuff for the I-944 you probably won't make it tomorrow

Yes overstay at present and forget about the past package, that never existed for uscis, so refer to present status and docs for any info.
