My first visit to local ASC  2 months ago

I reached at 9 AM and there was no applicant and ASC was empty. I went and talked to officer and requested her to get me a biometrics appointment as they cleary have slots and they are waiting got people to show up. She said they don’t have any access to schedule and I need to call USICS.

 

Today (12/18/2020 ). I paid another visit to check how busy ASC was. I waited outside ASC for roughly 1 Hour.

I saw two applicant's going in. Biometrics talking around 5 mins each. Then for rest 50 mins there was literally no applicant. I was socked to see that again. So I went and tried to talk to the officer and requested him to get me Biometrics. Following is the dialog I exchanged with him (He was very nice guy).

 

Me : Hello Officer this is my receipt and I filed in May , could you please check I haven't got any Biometrics.

Officer : He takes my NOA for I-765 and goes inside to check in the system. He comes back and said sorry sir you don’t have Biometrics scheduled.

Me: Can you please schedule one for me as you clearly have slots.

Officer : I am sorry ,We aren't allowed and have no access to schedule it for you please call USICS they only can do that.

Me: I called them hundreds of time. They said  "Your information is in scheduling  system, ASC doesn’t have empty slots so when ASC have slots , system will schedule".

Officer : Well as you can see we clearly have many empty slots everyday. We have already notified USCIS that there are empty slots and we can have many more people. But USICS is not doing that.

Me : This is so not fair , I am about to loose my job because of not having EAD which needs biometrics.

Officer : Well if it would have upto me then , I would line up people in the distance out here as we have lot of space. And get it done with but USICS doesn’t allow us to schedule. We just get list of appointments every day in the system and that are less so is why you see it empty right now. Unfortunately for you calling USICS  800 number is the only option.

Me : I have called them million times , opened several Service request , contacted congressman as well .

 

Me : Anyways thank you so much for talking time to talk with me.

I waited 10 more mins and to check if there were any other applicants and I then left.

I did exactly that prior receiving my appointment and I think I shared my story here. Keep trying to call them and at least talk to a tier 2.

expedite faxed firs time: November/25, second time: December/02 ( request for 131 approved which was weird because I didn't expedite 131), third time: December/16

Case approved (I765, I131) December/18 

 

I had a job offer and requested based on financial loss. I talked to tier 2 but it wasn't helpful. I hope the card will be delivered soon and I can officially start my job. Hopefully, everyone will get their documents soon.

Waaaw congratulations 🎊🎈🎉 so did they ask you for RFE when made your expedite request ?

I don't know if I understand your question correctly. Mine was RFIE not RFE which means an initial document was missing for I864. I sent that document myself and I didn't have any lawyer. Then, there wasn't any news since that time which means they accepted my document for I864. What I did for EAD, was expediting. I waited for two days from the day of request and then they sent me an email asking fo documents that shows I'm in an financial loss situation. Then, I faxed the documents(not mail or email, I faxed it). Please let me know if you have further questions.

Oh okay, I understand better now. Thank you so much for such a detailed message. In my case I made an expedite 17 days ago they never asked me any proof of financial loss. I thought you just decided to send the proof by yourself without them asking you those informations. I’m losing my mind as I don’t know where to stand. This morning again I received an email stating “ we have take an action on your case “ but so far they just update my DOB on my I-131 expedite request and my I-485 changed to case ready to be schedule. I’m wondering if I should make another expedite it’s so weird. ( I-765 expedite was also financial loss). Thank you so much again and huge congratulations 🎉 to you for this amazing news.

I'm so sorry to hear that. This year, everything was super weird. If they haven't responded you within 5 days, you can contact USCIS and tell them that you requested 17 days ago. I would say try to follow up with via congressman too.

Congrats Hazhartkd for finally getting your ead card produced.

 

My card was also being produced on Friday the 18th after I expedited my case on the 11th of December (after my biometrics were taken). The sent me an email on the 16th asking for additional documents to be faxed. I ended up writing a cover letter and added a copy of my wife's student loan, my job offer letter and the email log with my future employer.

 

In the cover letter I explained that I was offered this job over 2 month ago and that both the company and I are experiencing "severe financial loss" following the amount of time it takes for them to approve the case. i also wrote that the case had been outside of normal processing time for over a month and that hopefully it would help them approving the production of my card.

 

I'm not sure if the expedited request helped at all or if it was just luck. They didn't email me after receiving it but they just approved it.

 

Good luck to you Faith2020, I know you've been patient but I would try to re-expedite it if they haven't replied after more than 20 days.

I filed under financial loss to a company or a person. And showed in my letter than both the company that's hiring me and myself would be losing money if it is delayed any longer. If you've received a job offer you can try that and even ask your company to provide a proof of the financial loss they are experiencing due to your delayed start.

If you don't have a job offer I believe it gets harder to have an expedited request approved. But expedited should be hard to obtain only if your inside the normal processing time in my opinion. In our case we're not so that would still be worth trying.

Thank you so much. I will try that and see. I also hope for a Christmas miracle. I also expedite my I-131 that one seems to move but not that much either few days ago they updated my DOB on my case but that was about it. I think expedite might be luck as well but tomorrow I will re-expedite my I-765 again.
