Hi All. I AM A K1 visa holder and arrived in USA in February. We got delayed to get married due to Covid 19 but eventually got married early May. Im in the process of completing forms and collecting all necessary evidence. I have 2 questions.

1. Is it compulsory  to complete form i 131 if i do not have any plans to travel out if America any time soon.

2. My I 94 is expiring this week, will i encounter any problems for my green card application if my documents reach USCIS after my i94 expiration. Tia

The I-131 is optional  but HIGHLY recommended you file it as it costs no extra fee. You never know what may happen in the future

I would STRONGLY recommend you file it. The I-94 expiring is no big deal insofar as filing your AOS just file as soon as you can. As long as you were married within the 90 days time frame you are fine. But seriously file the I-131.

My husband got an RFE for his long form birth certificate (England) and for my most recent tax transcript (I gave in my 2019 W2s, my 2018 W2s and tax transcript as I have not filed for 2019 yet).  Can anyone help on how to fix this?

On the I-944 did you explain why you didn’t file 2019 taxes yet?

Also, a friend of mine had to request and send in the long form birth certificate for their RFE, this was for Canada.

Turns out, I didn't send in my 2018 W2s. They are sitting on my shelf. Can anyone help verify that complete Federal tax return for the current year means both the 2018 W2 and transcript since the 2019 taxes aren't due til July 15th 2020?

Hey guys. I'm trying to finish my I-944 form and I'm confused about Part 4 which is about education. I got my high school and college degrees in Turkey. My high school degree in Turkish without transcripts. My college degree is both Turkish and English with transcripts. So my question is should I pay for evaluation services and got the documentation or is it fine just sending English translation of high school degree and my college degree?

May 16 our third try was received at Chicago. 1st rejected for using the i-485 that expires 2021 even though that form has been accepted in some cases - according to the forums for AOS filers in April. Second rejection was for missing i-864 for K-2. I only included one for K-1 with the K-2 listed on it, but I realize now that they want a signed form for both - so make sure you send two of every form for K-1 and K-2. I'd be happy to receive an RFE as long as I don't get that packet back again in my mailbox! I'm hoping they will cash that check soon. I don't want to be posting in June AOS filers...

@taximan683 I’m sorry you have so much poor luck with the filing....I’ve just sent mine with a I-485 form that expires in 2021 and I’m sure I got it off the USCIS site but prior to checking before I sent it I did notice that the current form they had was 2020 so thought it’d be ok????

They have accepted some, but mine and some others were rejected. I hope you have good luck. It doesn't seem fair for them to reject a form that has not expired, but they hold all the cards. We just have to keep trying until they accept.

They go by the edition date of the forms too, not just the expiration date

just send what you have transcripts for. I wouldn't pay extra money

The I-944 instructions state, “foreign education should include an evaluation of equivalency to education or degrees acquired at accredited colleges, universities, or educational institutions in the United States.”

My interruption was anything listed in that section, which includes HS, would need to be evaluated so we paid to get his high school evaluated. I think it was like $100 and took like 4 weeks to get the official document.

The $100 was worth it to us, even though it added an extra month to file. It was worth the piece of mind of an RFE and we figured they’ll probably come in use again in the future for university.

Our I-693 will have doctor's signature that is ~75 days old by the time USCIS received our forms. Guidelines say 60 days but our wedding was postponed (twice) due to lockdowns. Should we still send this form right now and explain in cover letter why?

Also seems like we have to re-fill I-485 because the version we have has expiration in 2021 which doesn't match the latest online form.
