Finally got my biometrics done on Monday (8/31) at San Jose ASC! My packet was received May 5th, and the biometrics letter came 2 weeks ago around Aug 12th. I also expedited my EAD via a senator, and the card went in production as soon as biometrics were added to my case.

 

For those of you who got your biometrics done recently, how soon did it take to update to "Ready to Schedule for Interview"? I haven't received any RFEs other than a I-693 courtesy letter in June.

Our case updated to ready to schedule for interview less than 2 days after biometrics.  However, I have seen others waiting far longer, so don't be discouraged if that doesn't happen.

I have a question about income tax. I haven't filed for 2019 yet. We were married in 2019 and my wife has a social security number that is not authorized for work. We are waiting for the EAD and her new social security card, and a social security card for our K-2. My wife and step-daughter were living with me in 2019 for six months, and we will be due a refund when we file, but I need those clear SS#s. It looks like the SS#s won't come until after the filing deadline of October 15. Do I need to get ITINs and file on time, or is it not a problem since we don't owe? Should we just wait to file until the EAD is done? My plan is to wait it out and file late, but I'm wondering if there are any negative consequences if I do this.

Your wife's social security number will still be the same. Even with EAD, the new card will stay have the same phrasing about the work authorization.

 

So you can file now with the SSN for your wife and a ITIN request for the K2.

That statement has no bearing on whether  you can file or not. That statement will remain on the SS card until GC. No need to wait to file.

My letter said Code 2 (even though I filed I-485,I-131 & I-765 concurrently), when I got there & checked in, there must have been a note on my file as they said they would be doing Code 3 biometrics. My case status for the I-485 & I-765 has changed to "My Case Was Updated To Show Fingerprints Were Taken". For my I-131 application it still says My Case Was Received. 

Does that sound normal? How long could it be until I receive my Combo card?

I am in the same situation. After a couple days, my I-485 status changed to " Ready to be Scheduled for An Interview" but I-131 is still same. I gave 10 fingerprints with picture so it's like Code 3 and I read from August filers, some officers said it's like an error and they sending everyone Code 2 while it's gotta be Code 3.  So I guess it's like this for a lot of us.

Ya thats how ours was, we got biometric done 8/4/2020 and case updated 8/5/2020 to finger prints were taken. Still no update since. But iv been told that not everyones will update it just depends if the officer is updating for you to see or just working on case and not putting an update .

I spoke with someone on the USCIS live chat, they weren't really helpful, just said not to worry about it! I guess not much we can do then...just wait!

With AOS (I-485) interviews just around the horizon (hopefully) here are a few things I would like to share with you in case you are drawing blanks on what you will take to your interview. Although my interview was waived I was still prepared to attend so I am sharing what I was going to bring to my interview. Since I did not use it it'll be used during ROC provided we have a interview then. I have posted this before, but it's most handy to post in your own thread so the people can find it readily. Lot's of items won't apply to you and I understand younger couples won't have near the amount of items. USCIS does expect you to have basic items that married couples produce together, so if you don't have it you only can bring what you have. Good luck to you all and I hope my little tidbits help you plan for your interviews:

 

 

I broke our materials down into folders (different colors) and carried them in a nice camo bag I had laying around. I prepared a master legend or key if you will so when the IO asks for a document or an evidence, I can look on my sheet and locate which color folder it is located in and pull the folder out and locate the document to give to the IO. Here are the documents I am taking:

 

All forms I-797C (Notice of Actions for AOS) included a I-797 NOA2 for the K1 also cause if you'll notice the interview sheet says bring EVERYTHING, they ever sent to you so we are electing to bring all but the kitchen sink!!!!!

 

Complete copy of the AOS packet and ALL supporting documents

Current year 2019 tax transcript

Job verification letter

2 months of pay stubs

retirement pay letters (if applicable to you)

USC passport

LPRs arrival documents to include K1 visa and I-94

USC B/C

marriage license

SS card in married name

military ID card (if applicable to you)

divorce decree (if applicable to you) both USC and LPR

health, dental and vision insurance

life insurances both for USC and LPR listing each other as beneficiaries

ROM (report of marriage) this is Philippines specific

last will and testament to include Texas advance directive and power of attorney (this is also great for ROC)

utility bills with both names

bank statements savings and checking

joint credit cards (actual card as statement does not list who made a charge)

large purchases receipt (furniture with both names on it)

assorted mail LPR has received at her present location we share

and finally, the entire copy of the K1 packet to include all documentation

 

There is no rental agreement or mortgage contract with both names because I owned our house before we married so I included a mortgage statement to show when the house was purchased before, we married! I also used the term LPR as my wife has her GC already. Several documents will be redundant because I did not want to break open the entire AOS packet until and if I need to.

 

Like I said we threw in everything but the kitchen sink and I would have included that had it fit inside my handy carry bag. As you know with my luck that I have had throughout this visa journey I can't be to unprepared. My motto "better to have it and not need it, then to need it and not have it!!!!!

Well, I looked into it further and I can't claim the K-2 as a dependent because she was in the USA only 177 days in 2019 and would not be considered an resident alien. She has to be in the USA 183 days, so that 6 days cost me about $3,000. She doesn't qualify as a dependent if she is a non-resident alien. I thought about filing with her as a resident alien and hope they don't notice, but to get the ITIN you have to provide a document showing the date she entered the country.

 

That made things easier anyway. I just left the K-2 off of the return and filed jointly with my K-1. That's a load off my mind. I was afraid to send her passport to the IRS, and I didn't want to pay an acceptance agent for the ITIN.

 

Taxes done, that's one less thing to worry about now.

Hi Guys,

 

I'm glad it's going faster for you guys than me, and I have a few questions.

 

  • For those of you that have their case at the NBC, have any of you received fingerprints appointment yet?
  • Also how do you know for sure where your case is at? I'm assuming it's at the NBC because that's what my NOA says under "USCIS office address" but who knows..
  • Uscis processing time says it should take 28 to 37 month to process EAD. What is this timelines?? If I recall it was like 5 to 7 months about a month ago.
