Timeline

I received my 765 pack back and a letter saying the form is an outdated version. I download the form at USCIS website.

This is the second rejection, first time they said it was missing the fee. I resent with a copy of the 485 NOA1.

The form 765 at the USCIS website says it expires 05/31/2020.

I don't know what to do now.

Which form version did you use?

 

The USCIS website for that form says "We will publish a new edition of this form soon. In the meantime, you may continue using the 12/26/19 edition despite the expiration date. You can find the edition date at the bottom of the page on the form and instructions."

 

We filed that version as part of a I-485 packet, to the Chicago lockbox, delivered 3 June 2020, and it was accepted.

 

If it's only that one form that was rejected, I'd say resubmit it, with a dated printout of the USCIS page showing that that form should be accepted despite the expiration date. It also looks like you should write "Attn: FBAS" if you are only submitting that one form and have a pending I-485.

Expiry date of the form does not matter as long as you file the correct version of the form on the day of filing.

That's correct check the version date!

Don't get discouraged it takes quite a few couples at least 3 times to get accepted due to the new form I-944, so don't feel like you are alone. I know you wanted it to go through the first go round, but don't sweat it get back up on the horse and send it in again!!!! Check the version date of your forms, that's what they go by!

I called USCIS and mentioned the fact that the form is outdated on the website.

They said it might have been a mistake and I should resend the form again.

I resend today attaching the screen print of the website stating "We will publish a new edition of this form soon. In the meantime, you may continue using the 12/26/19 edition despite the expiration date. You can find the edition date at the bottom of the page on the form and instructions."

Fingers crossed they will accept this time :)

I sent the correct version (12/26/2019 on the bottom line) but even though it got rejected. 

It was an USCIS mistake.

Thank you for your encouraging words. I resent the form today, hopefully I will receive the NOA soon.

Thursday I received notice that the received my answer to RFE and start again to look my case. And said that they will notice me if they will need something else. Is it common to have RFE. What do you think i can wait for next?

You will have to wait for them to adjudicate  your case.

Is biometric appointment notice is after this? With second wave of COVID quarantine and mask required in Kansas and Missouri  i hope to have is as soon as possible.

Not real sure now with all the covad stuff. It used to take around 30 days.
