Hi May Filers,

My case will be out of time according to the timeline given by USCIS. What do you guys recommend for me to do? I'll do service request, but do you think they respond to service request?

There is a process for inquiry for cases beyond the published date, we are not there yet, so I have not looked into the details of how to do it.  That date is still in January 2020 for us.  It will be another 4 months before we can file an inquiry.

It's been two months since we filed our "Outside normal processing time" inquiry (and the "receipt date for a case inquiry" is already two months past our date) with no response. The case status on https://egov.uscis.gov/ says "your inquiry about why your case is taking longer than our processing time, referral number X, is currently not assigned for processing."

So ¯\_(ツ)_/¯

Timeline for Adjustment of Status:

  • May 4, 2020 (0 days) - 'Application received' (I-485, I-765)
  • Feb 8, 2021 (9 months, 3 days!) - 'Fingerprints taken', one day after biometrics appointment
  • Apr 13, 2021 (11 months, 8 days!) - 'New card is being produced' for I-765, employment authorization
  • Apr 17, 2021 (11 months, 12 days) - Original EAD delivered by USPS
  • Mar 29, 2022 (1 year, 10 months, 25 days!) - Case 'Ready to be scheduled for an interview'
  • Jan 18, 2023 (2 years, 8 months, 14 days!) - Received RFE for I-693 + evidence of marriage (I-751?)
  • May 2, 2023 (2 years, 11 months, 28 days!) - I-485 application approved!
  • May 9, 2023 (3 years, 5 days; or 36 months, 5 days; or 1100 days!!!) - 10-year permanent resident card delivered!

Timeline for EAD renewal:

  • Feb 23, 2022 (0 days) - 'Application received' (I-765)
  • Feb 25, 2022 (2 days!) - 'Card is being produced' for I-765
  • Mar 4, 2022 (9 days 🤯) - renewed EAD delivered by USPS

Timeline for travel authorization:

  • Oct 7, 2022 (0 days) - 'Application received' (I-131)
  • Dec 2, 2022 (56 days) - 'Fingerprints taken'
  • Dec 6, 2022 (60 days) - Advance Parole Document was produced

Oh, I'm sorry, that's so disappointing.

The link that you mentioned can not even detect my request number. I don't know if a lawyer or an expedite would help!!!!

First time posting, but I applied AOS on 5/5/2020, and did my biometrics on 8/13/2020. Received my combo card in Oct 2020 and filed for renewal in March 2021. It's been nothing since.

At the end of January I reached out to my congressman for an update since I've filed 3 out-of-processing-time requests but never heard back on anything. Today I was informed that my combo card renewal was approved for 2 years, and my AOS was in suspense because they did not have my biometric and scheduled me for another biometric for March.

Well first of all I am very happy about the approved combo card so I can continue working and travelling if I want to, and it's a two year combo card. But I just can't get how incompetent USCIS is that they are giving the excuse of missing biometric. I mean if they don't have my biometric then my combo card wouldn't be approved back in Oct 2020 nor will my renewal be approved today. I guess they just want to convince the congressman that it's not their fault.

Anyways, I will attend the biometric appointment 1.5 years after my first one. Code is 5 which is one hand only vs the typical AOS code 3 of two hands. Really hope to get "ready to be scheduled interview" soon after the second biometric.

So guys, yes, reach out to your congressman, it does help!

That is bizarre and does not make sense that they don't have the biometric, but I'm happy that you got your combo card. How long did it take for getting a response from congressman?

It took like 3.5 weeks to hear back. At least they respond to congressman vs doing nothing on our service requests.

Another first time posting here! We are in quite a similar situation. Filed AOS on 2020-05-04 (from K-1), had "first" biometrics on 2020-08-07, received a combo card Oct 2020, filed for renewal in April 2021.

Our I-485 case was stuck showing "Fingerprint fee received" and never changed after the first biometrics (2020-08-07). But we read that some people never received any update so we just let it be. But then around December 2021, our attorney reached out to the local office and was told that the biometrics was unacceptable by the FBI and they will need to schedule a new biometrics. There was no notice to let us know about the problem at all until our attorney reached out to the local office. Had our attorney not reached out, I think we will never know and would just sit and wait for nothing ... 😢

To make things worse, the "second" biometrics was sent to our old address even though we already updated the address online (I-485 status changed to Notice Was Returned). The notice was never delivered to our attorney too. We requested another copy of the notice and this time USPS forwarded the notice to us. She just had her biometrics done 2022-02-14 but the case status is still "Notice Was Returned". Our I-485 will be out of normal processing time in May (assuming that it's still 24 months at that time). Combo card is still not processed and the automatic 180-day extension is expiring in a few weeks.

Does anyone know if we can still call the FBI to check the status of the biometrics? I read that you can call the FBI and give them the A-number, but it seems like they stopped providing that info? We don't want to just sit and wait as it seems like the updates are not reliable.

The softcopy biometric appointment letter my congressman forwarded me was also my old address. I guess I better call a tier 2 and ask them to reissue me one with new address to avoid the "notice returned" status.

My status did change to "fingerprints taken" so still not sure why they needed my biometric again...

Keep us updated on the FBI status you can find - interested to know that for sure...Good luck!

Congratulations! that's a good news. Did you take any action? I mean, did you contact congressman/senator or did you send any service request?

No, no action on my part. I was fortunate enough to get my EAD on time, for the rest just wait.

No, they haven't asked. I'll have to provide that at the interview.
