Let's say my husband gets here by December 2020 and he gets the green card in march 2021. Would he qualify for 10yr green card? 

 

Or does it have to be 2yr at the time of Consular Interview or POE?

I've finally graduated up from the "I-130 Filers (July 2019)" thread to "NVC Filers (May 2020)". Nice to be up here with you all! :)

 

We submitted ALL of our documents to the CEAC website on May 10. Does anyone know how long it takes for NVC to change documents from "submitted" to "Accepted"? I've mostly just seen people  asking about "accepted" to "qualified," but I'm not quite there yet. 

 

Also, I saw someone post this back in April regarding NVC timelines: "current review as of 27 Apr 2020 is 13 Feb 2020." As of May 11, the timeline STILL says 13 Feb. Have they really not made any progress since April 27?! :(

Hi it seems like NVC is pretty slow since the last two weeks. You can expect your documents to be reviewed within a matter of few days to 10 weeks. Nobody really knows whose documents NVC reviews first. Hope that helps !

Yeah, there seem to be no pattern, but they did DQ a lot in the past week so there is some progress. 

Now we are all backed up waiting for interviews.

So when you receive a "Documents Accepted" note... does that mean that they've actually reviewed your document and decided that they are good to go? Or does it just mean that things have been submitted correctly and you're in the system, but they won't actually review anything or give you an answer until a later date? 

 

I looked at it like "documents accepted" was like getting a NOA1 (we received your stuff, it's in the computer)... and "documents qualified" as a NOA2 (we reviewed it, you did it all right, and you're approved to the next phase). With this way of thinking, I was hoping to get a a Documents Accepted within the first couple weeks, and then wait longer for the DQ part. But maybe that's the wrong way to look at it?

Uff, I can't imagine the delay we are going to have for getting an interview spot... I'm bracing for like a 5-6 month delay minimum. :(  Just to keep my expectations low!

"Accepted" means that this particular document has been reviewed and is good to go. Each individual document can be accepted or denied. Even if all your documents have "accepted", it's possible that a document is missing entirely which is the reason that "accepted" does not equal DQ.

I believe It has to be 2 years at the time of entry.  The CBP officer will determine that at the POE. For me, my two years of marriage was on April 2020. On CEAC it now shows as IR1 instead of CR1.

I called NVC last night and according to the rep that date is accurate.

It is POE, correct. And I recommend not to fully rely on CBP Officer, but rather make sure that it gets determined correctly at POE because nobody wants to deal with the paperwork if it’s done wrong 😄

You are right. Just make sure they are issuing the correct category. It would work the same way if they issued a IR1 and the spouse only qualifies for a CR1. You would have to correct that as well.
