Hi all,

 

My husband and I received our NVC notice and are able to start the visa application. I am the beneficiary and will be the sponsor for him (I'm a US citizen and he is from the UK). I just filed my 2019 taxes, and I don't meet the income requirements based on the taxes. For the first half of 2019, I was a graduate assistant and still attending graduate school full time, so I definitely did not make anywhere near the required amount, however, in August of 2019, I started a full-time internship, for which my pay would be $21,900.00 for the duration of my internship which is August-June (but would still be receiving payments in July until the end of the fiscal year which is in July). Then, in October/November of 2019, I received a notification from my employer that the Ohio state teacher minimum salary increased from 21,900 (I received state teacher minimum salary as a school psych intern) to $30,000, so my pay then increased to $30,000, however I only began receiving a larger pay check after late October/Early November of 2019, but will continue to receive this until July or so (but this is not reflective in my 2019 taxes). As I am graduating very soon and will begin working as a school psychologist, I have been applying for jobs and have decided to accept one of my job offers. I have been offered $65,800, and will be on a 215 day per year contract, and the contract begins August 1 and ends June 18. My future supervisor notified me that yesterday the board was going to be approving my contract and that I would be receiving employment paperwork and the contract to sign in the next few days. I guess my question is- what do I do? On the I-864 it asks what my current income is. Technically, my income is currently 30,000 but that isn't what my income was for all of 2019. My internship funding/pay comes from the Ohio Dept. of Education, and is distributed to my fiscal agent (my current district that I'm interning in) to be disbursed like it's a salary but it really isn't and I will only be making that until July. Also, my original contract has me making 21,900, which was what I was making in August, September, and October of 2019 until the state teacher minimum salary was raised to 30,000. Also, on August 1, I will be starting my new job making 65,800, and while I'm not making that at this moment, it is what I will be making starting in August of 2020, and in the next few days, will have a signed contract to prove that. So, does anyone have any tips or answers for me on how to best complete form I-864?

Thank you! I guess piggybacking off of that, would I then say that my current income is 30,000 because that is the amount that I am earning right now even though my internship contract expires at the end of July? Also, this is kind of a weird way of putting it, but would 30,000 technically even be the amount I am earning if my contract was for 21,900 for the whole of my contract, which was then increased to 30,000 in November of 2019? I'm not even sure if this makes any sense what I'm asking, I guess I'm asking if I need to do the math and say that I make like 26,000 or something since I was only paid 21,900 for 1/2 of August and all of September and October before jumping up to 30,000. Also, what happens if we don't get an appointment at the embassy until after I have already started my new job?

Your current income is 30,000.  An employed person's current income does not come from a tax return.  Don't confuse the two.  They are separate questions.

 

Note that your husband is the beneficiary and visa applicant.  YOU are the petitioner, and sponsor.
