Hello po! Im confused, K1 exempted or not in the Proclamation?

 

We are in  the interview and waiting stage but Manila Embassy will going to open in April 30 but not until May 4 as normal working days. There are few areas in Luzon that are still under strict lockdown until May 14 or 15 because they have more cases. My question is that true that Manila Embassy is not going to accept appointments until June? 

 

Im sorry my English is not that good.

I suppose since you waiting for interview already, you can mail the consulate in Manila and ask them for clarification....do let us know what their response is.

K1 is not subject to the EO

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

My other concern is, my ceac status was "in transit" for 17 days now. Is thats normal? 

I dont know how long it should be but i understand the delays this covid causing.

All consulates are closed.   NVC is holding all completed petitions.

Yes it’s normal until the embassy is not opened

K1 is a nonimmigrant Visa.   EO is suspending certain immigrant visas

A when K1 is printed it does not say Immigrant Visa on it.

A K1 requires AOS in order to obtain residency.  Immigrant Visas do not.  In fact a spousal visa becomes a green card, for a year, when stamped at POE.

A K1 can waive immunizations at medical.  An Immigrant Visa can not.

 

Plus the USCIS website states it is non immigrant https://www.uscis.gov/family/family-us-citizens/visas-fiancees-us-citizens

as does the Department of State's https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/nonimmigrant-visa-for-a-fiance-k-1.html
