Hello,

 

My in-laws were scheduled to go back home this passed Tuesday. Last Friday the EU announced border closures until May 19th. They have been scrambling trying to get all the documents together for filing an extension. They are filing for an extension of their visa since their i-95 expires on May 3, 2020. Out of an abundance of caution I wondered what date they should put as the requested extension date? I already had their tickets home changed but I wondered if they could/should put down a later date in case their flight gets cancelled again because of COVID-19.  They are filing online one application for each since it is such a short turn around time and I want to make sure they can come back again to visit. It is quite pricey and we do not want them to have to do it twice if somehow their requested extension must be extended again in the future because of the pandemic.

 

Specifically the question online is: "what date are you requesting your current or requested status be extended until?" 

 

If their ticket is purchased for June can they ask for the extension until September just to be safe?

The ban does not apply to Citizens, I know many Countries have arranged repatriation flights for their citizens.

I don't think it is a short turn around time, tourist visa extension usually takes 3-4 months to process, and If it is denied any overstay is held against you and your chance of getting a Visa for the US again goes to under 1% probably. I would try to find a way to have them exit the country before their I95 is expired.

Am I missing something here? 

 

Why didn’t the in-laws return home when scheduled to do so?  

If they are citizens, I’m sure they are allowed to return home - borders closed just to foreign nationals no?  And that depends on where in the EU they are from. There are still flights from the USA to Europe.  

 

Also, this virus pandemic didn’t just spring up all of a sudden last Friday.  So why are you “scrambling” to get documents together.  

When tourists were warned that this could happen MONTHS ago, why didn’t you arrange for the in-laws to get home in a timely manner?  Why did they stay and risk overstaying and ever being allowed to visit ever again?    

 

Tourists had every opportunity to repatriate in a timely manner, and failing to do so is all on you, and your in-laws, pushing it to the last week before their visas expire is highly irresponsible no?

It is recommended to match the date of travel with the extension date as you may probably have to include the itinerary as a part of evidence of departure plan. It is pointless to put June extension date though as by the time they see your file for review, it will likely be past June and will be denied for sure.

 

why separate filing and not only one for spouses? I don’t think you’ll gain anything on processing times by separate filing.

Yeah I would agree with this - I don’t think the OP can pick n choose a departure date to suit.  

 

The extension will either be accepted, and I believe it will be for another 6 months, or denied.  I have heard cases of further extensions being granted, but I would assume these would carry much greater scrutiny, and very much an exceptional circumstance.
