Affidavit of Support I-864

Hello everyone,

 

Hope you guys doing well. I do have a question regarding on submitting Affidavit of Support. My father filed a petition for my sister back in 2011 and she is under F1 category (Unmarried Sons and Daughters of U.S. Citizen). Her priority date will be current soon and we are preparing all the required documentation. Since my father did not meet the minimum income requirement and I will be the joint sponsor for my sister. Does my father still need to complete the I-864EZ? or we have to do both I-864EZ and I-864? Your responses would be highly appreciated.

As the petitioner, he is the primary sponsor and an I-864 is required from him. This can be an I-864 or I-864EZ, if he qualifies for the latter. This means evidence of his income is still required, along with tax return copy (and having filed taxes for at least the past 3 years, unless income was below the threshold to file).

The joint sponsor will need to complete an I-864. No I-864EZ for them as they would not qualify via the 1st question on it.

Thanks for the response. So which one does my father needs to complete? I-846 or I-864EZ since my father did not meet the minimum income requirement?

If he can answer Yes to the 1st 3 questions on the I-864EZ then he is eligible to use that. He can still use an I-864 if he wants instead.

If he is not eligible for the I-864EZ, he must use the I-864.

Thanks for the info geowrian. At least we already have an idea how to complete the form.

One more question regarding on joint sponsor. Who will be completing the I-864 form joint sponsor? is it my father or myself since I will be the joint sponsor? this forms makes me confuse, thanks.

You each will complete a separate affidavit of support. You will each have your own evidences and tax returns. Treat them separately.
