Hi,

I live in the U.S. and filed an i-130 for my spouse who will interview in the U.S. embassy.

For a joint sponsor (parent) who is married, filed a joint tax return with his wife, both retired but with substantial passive income that is considered equally generated (e.g., from real estate, investments, etc) and owned by both, should they put half of the income on the i864 and half of the income on the i864a such that the addition of the income of the two forms equals the amount on their joint tax return?  Or do they put the total income of their joint tax return on each of the i864 and i864a?  Or other?

Your irs transcripts should confirm the joint sharing of passive income (1099) so I would be using 50% on each form. Others might share other insights ..

For the tax section of the forms, the amounts will be equal.  For the individual income section, divide as applicable with the passive/investment/etc. income split.  This is per the actual form instructions.

Facts are cheap...knowing how to use them is precious...

By equal, I mean the total income from the tax return will appear on both forms, in the tax sections.  Individual income will be different on each form, unless it is actually appropriate to halve the total.  Usually it would not be, as the Social Security and/or other pension income will not be the same for husband as for wife etc.
