The i130 asked if you’ve ever applied and if it was accepted or not. My husbands was approved and we lived in the US for 5 years. We’ve been gone for 3 years now and need to go back. Anyone else have knowledge of how the USCIS takes these types of applications? Would we be frowned upon for giving up a green card then needing one to go back. My husband has his SS number and everything, as well as a job to return to in the US. Thank you for any help. 

Yes we did it. Relinquish the previous GC .. firm 407 I think .. then apply again. Not going to happen  quickly.

No quicker because of previous history .. but no slower  either

Correct terminology is helpful.  You, the US Citizen, will "file" a petition.  He, the foreign spouse will apply for a visa buy submitting a DS260.  DS260 is an application that is "submitted".   The I-130 is a "petition" you "file.

 

I don't see anything speeding up, Trump or not.

We are in the same process, 2nd time around. Waiting for the interview. First time was a breeze, so many years ago. Had I known it was so difficult now, I would have explored other alternatives to try to keep the first GC valid. Reason for abandoning the GC, wife's mother became very ill and needed her as guardian since 2014.

I would have too. This has become such a mess. We’ve been waiting for an interview for 6 months now, still nothing. Are u bringing proof of relinquishing the past gc? I’m not sure if my husband will be questioned about that. Makes me nervous.

I should have received a letter from the DHS at the US consulate in Peru but only received an email with a PDF copy of the I407 form we sent abandoning the first Green Card. The form had been updated though with a date of receipt stamp and recognition of the abandonment expressed in the last 4 parts of page 2.. We are also in our 6th month since NOA2. Covid19 has created quite a large backlog...

We relinquished the first GC in Feb, 2018 and filed the I-130 in Oct. 2018. No problem.
