Help please , i will file a I-130 for my brother before july 31st - however he gets married in the middle of July and he will need to get his marriage certificate translated into english - do i need to send the marriage certificate with the I-130 as it does not specify this on the I-130 form or can i wait until they ask for it .?

If this is a visa for your brother's future spouse, yes they will need a copy of marriage cert attached to the petition.

Also mailing July 31 wont avoid the fee increase, post mark July 29 or before would.

I-130 instructions:

4. What Are the General Filing Instructions?

D. Translations. Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that he or she is competent to translate the foreign language into English.

7. What Documents Do You Need to Prove a Family Relationship?

A. A husband or wife, submit the following documentation:

1) A copy of your marriage certificate.

2) If either you or your spouse were previously married submit copies of documents showing that all prior marriages were legally terminated.

If you are trying to beat the fee increase, you may try sending in the petition without it and wait for the RFE to send it in.

Whats an RFE ?? and yes i have everything ready ,want to beat the price increase but as i say not sure if they will have the marriage certificate translated in time .

You don't need your brother's marriage certificate with I-130. You will need to submit your birth certificate and your brother's birth certificate. However, you will need to enter the name, date of birth, place of birth, etc of the wife of your brother in the appropriate area. You can send your I-130 petition right after your brother's marriage.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
