I had followed the advice from this forum that to write down the "NRA" on my SSN part of the paper version of the tax return form,  and then mailed it to IRS at the beginning of April. However, currently the IRS has closed due to the COVID19, and I heard from my friend saying that IRS no longer accepted or processed the paper version of tax return form any more.

 

We have not got any reply or response from IRS after we mailed the paper version tax form in the earlier April, so we supposed that the IRS does not deal with paper version of tax return anymore. Could anybody give me any suggestion about how could we file the tax return for my husband If I do not have SSN or IRS number?

if I'm not mistaken MFS are they only ones required/allowed to file paper and mail it (I might be wrong). I filed my taxes just like the forum told you (paper) and a month and half later they  processed it.

Concerning the current income, if it is not going to continue from the exact same job and employer when you move to the US, then don’t list it. Get a joint sponsor.

 

 

 

Hi, I really appreciate your suggestion. I just read the instruction of I-864 and also the domicile part, I did not find it mentions that the overseas income cannot be constituted as the sponsor's income to fill out the I-864. Could you help me specify it on which part of the instruction? Thank you so much!

Since you mentioned that your husband moved outside of the US - you might also have to prepare him to show intend to re-establish domicile in the US for you to get approved.

Hi, thank you so much for your suggestion. My husband just moved here in March, and currently because of the COVID, we are not very sure if he can find a job immediately in U.S. if he goes back to U.S. now. We are going to help him find a job in U.S. now, but it may takes longer time due to the pandemic. Do you think a U.S. job offer is a must-have thing before the interview?

I don’t think it says that, other than in reference to the immigrant’s income being counted. But for most I-864s, the sponsor is working in the US, which is probably why they don’t specifically mention the sponsor.  I think you would be asked for documentation at your interview that the specific job/employer he listed will continue. That is sometimes accomplished by working remotely at the same job, or a US counterpart within the same company, or him being legally able to continue work in Canada by commuting. If he has no job when you get the visa and move, it doesn’t seem logical that he can affirm continuing support.

I see. Thank you very much for the detailed explanation. Currently due to the pandemic, my husband said he does not want to quit his current job, and he said he wants to work in Canada for more years. How long is the time for us to fill out the I-864 form before the next steps?

You haven’t filled out a timeline in your profile, so we don’t know what step(s) you’ve already done or when.

Thanks a lot for your continuous help on my case! I am sorry that I have not added my timeline there, and I am going to complete my visa process soon later.😳 For my process, I just got the I-130 APPROVED, and now I am going to move to the step of filling the Affidavit of Support.

 

I know that my husband move out from U.S. at a bad time, and we did not do enough research before he resigned his job in U.S. in March...Now we are trying everything to fix his domicile problem...😥

It seems very hard for my husband to get a job offer very fast in U.S. now based on the pandemic. So we are thinking about hopefully we can find a job for him after my green card get approved. But currently I do not know how long is the time for me to fill out the I-864 form.

I believe I read in other areas of the forum that petitioners currently living abroad, need to proof intent to re-establish domicile in the US, and possibly a joint sponsor with US based income. Would your spouse be able to maintain the Canadian job once they move back to the US (e.g. is it a possible commuter job)?

 

@geowrian are you able to provide more insight on this part?

Domicile has already been covered in this thread and she understands it. She now needs help with the IR1/CR1 timeline as she has NOA2, but wants to stall two years so her American husband can continue to work his new job in Canada while unemployment is high in the US.  I don’t keep with timelines or spouse visas or Canada, so somebody jump in. I think her tax question is basically resolved and she has further new questions for a different forum.Suggestions about NVC timelines?

Once it reaches NVC stage, she can stall there. The case remains active for up to 1 year, so she can upload ans submit documents for NVC review 11.5 months after case was created at NVC. From there review will take some time, and interview can be re-scheduled to a later date once given.

Montreal was taking around 6 months or so to get an interview pre-COVID19. I would expect that to grow in time since then.

So it sounds like she can stagger things out pretty easily.
