HELP! Urgent! TAX return without SSN or IRS number.

Hi everyone,

 

I am the spouse of U.S. Citizen residing overseas, and I do not have the SSN or IRS number.

 

I had followed the advice from this forum that to write down the "NRA" on my SSN part of the paper version of the tax return form,  and then mailed it to IRS at the beginning of April. However, currently the IRS has closed due to the COVID19, and I heard from my friend saying that IRS no longer accepted or processed the paper version of tax return form any more.

 

We have not got any reply or response from IRS after we mailed the paper version tax form in the earlier April, so we supposed that the IRS does not deal with paper version of tax return anymore. Could anybody give me any suggestion about how could we file the tax return for my husband If I do not have SSN or IRS number?

This is really a tax question. The IRS is working and on the website they state: "Due to staffing issues, processing paper tax returns could take several weeks longer. Taxpayers and tax professionals are encouraged to file electronically." So you may have to just wait longer for them to process the paper tax return. I assume you know that the deadline for filing has been extended till July 15. So why is this case so urgent?

01/07/2017 (Saturday!) EAD/AP renewal package with new forms received in Phoenix "reception desk"
01/17/2017 EAD/AP renewal case accepted; text/email with receipt numbers was received
01/30/2017 Law firm finally confirms that USCIS has suspended processing all EB2-NIW cases due to new criteria. 
02/23/2017 USCIS slowly starts adjudicating NIW cases again.
04/21/2017 Extended EAD/AP received in mail. Valid for 2 years. 
05/06/2017 Received a massive RFE on I-140 NIW case.
07/20/2017 RFE response received by USCIS (a very long response with 30 pages of docs)

Thanks for your reply. My lawyer told me that I need to give him my husband's tax return information ASAP due to the current changing immigration policy in U.S.. The U.S. immigration may be temporarily shut down at any time in the near future, so the fast the better, which is understandable.

Keep the copy of your 1040 or whichever form you filed and that should be sufficient evidence for the timely filing. Are you filing jointly? It normally takes IRS a while to update your account records anyways.

Thanks a lot for your suggestion. Yes, I do have the copies of 1040 form that I mailed to IRS. But I have not got any confirmation or update from IRS by now. We have not received the tax return money either. Is the unconfirmed 1040 considered as valid evidence?

 

Our filling status is "Married filling separated", and I guess IRS might stopped processing the paper version tax report.

Keep the copy of the return and the mailing receipts. Together they should be sufficient as evidence for filing, especially given the circumstances (I'm not a lawyer so don't quote me on that). You may consider opening your account at IRS too (https://www.irs.gov/payments/view-your-tax-account) but they may require SSN to do that (not sure). Again, I'm just a guy on the internet. Go by whatever your attorney says but it sounds to me you've nothing to worry about if that's your only issue.

To be perfectly clear, you are not filing taxes.......your spouse, the US citizen, is the only one filing, correct?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

US immigration prefers an IRS tax transcript, but a copy of the 1040 that was filed plus W2, 1099s, all schedules, etc., should be acceptable since the IRS has stopped processing paper tax returns until the virus shutdown ends, then they'll start up again.  Prior years' IRS tax transcripts can be downloaded from the IRS website.  Good luck!

I am helping my husband fill out the forms for my husband, who is USC. So the tax forms I filled out is all under his name. I chose the "married separately filling" for him. Is any suggestion for my situation? Thank you so much!

Hi,

 

Thank you so much for your suggestion. My husband just started work since May of the last year. So his past half years' tax return is the only evidence we have by now, and he does not have any past tax transcript. His only tax return information is still being processed. I do not know what I could do at this step...Do you think half year's tax return is enough for the requirement?

He has to include his most recent tax return. You can’t get a transcript yet so photocopy all pages of the return and his W2 wage statements to submit. If his tax return only has a half year worked, then submit something that tells what his current income is. The form instructions say:

 

 

Number 7. Current Individual Annual Income. Type or print your current, individual, earned or retirement, annual income that you are using to meet the requirements of this affidavit and indicate the total in the space provided.

 You may include evidence supporting your claim about your expected income for the current year if you believe that submitting this evidence will help you establish ability to maintain sufficient income. You are not required to submit this evidence, however, unless specifically instructed to do so by a U.S. Government official. For example, you may include a recent letter from your employer, showing your employer’s address and telephone number, and indicating your annual salary. You may also provide pay stubs showing your income for the previous six months. If your claimed income includes alimony, child support, dividend or interest income, or income from any other source, you may also include evidence of that income

 

He earns more per year than his 2019 tax return shows so provide the employer letter and pay stubs to prove his current yearly income is enough.

Our case is a little bit special. After working for half year in U.S., my husband resigned his job in U.S this year., and he just moved to Canada to live with me in the last month. We got the I-130 approved last week, and we are going to fill out the I-864 form now. My husband's current income is enough to support me and has gone beyond the poverty line listed on the government website. I want to confirm with you, do you think we can use his current income on the I-864? Is the I-864 only supposed to write down the income in the U.S.?

Page 3-4 Item Number 5. Country of Domicile.

 

Concerning the current income, if it is not going to continue from the exact same job and employer when you move to the US, then don’t list it. Get a joint sponsor.

I don't know if Canada is an exception (wouldn't know if any reason why it would be), but generally only US based income can be considered for the affidavit of support. The government doesn't want to deal with foreign institutions if they need to access the money :)

Since you mentioned that your husband moved outside of the US - you might also have to prepare him to show intend to re-establish domicile in the US for you to get approved.
