The Politicized Order Inviting Amicus Briefs against the Flynn Case’s Dismissal
 

Lest we forget, the primary function of the federal judiciary is to protect the accused from overbearing government action, not to agitate for the prosecution of Americans. Even if he’s convinced Flynn is as guilty as the day is long, one might expect Judge Sullivan to be disturbed by the FBI’s perjury trap, by its editing of and misrepresentations about the “302 report” of Flynn’s interview. By the prosecution’s withholding of exculpatory evidence and concealment from the court of its threat to prosecute Flynn’s son. By the derelictions of Flynn’s original counsel, who took the case notwithstanding a deep conflict-of-interest, and who appear to have counseled Flynn to plead guilty without ever reviewing rudimentary discovery — we know they never inspected the 302 (which is mind-boggling in a false-statements case); did they ever demand that Mueller’s prosecutors produce the recording of the Flynn–Kislyak “sanctions” conversation that is the heart of the case?

Gregg Jarrett: Here's the real reason Obama officials targeted Flynn 'with a vengeance'
 

Obama-era officials involved in the unmasking of former national security adviser Gen. Michael Flynn went after him "with a vengeance" because they knew he would expose the "Russia hoax," Fox News legal analyst Gregg Jarrett asserted Thursday.

 

In an interview on "Fox & Friends" with host Steve Doocy, Jarrett said that he had asked a top intelligence official why Flynn had been targeted during the 2016 transition period and the official told him it was a punitive concerted effort and a "conspiracy."

 

"And I think it's because, you know, Flynn had a bull's-eye on his back. People like Comey, McCabe, Brennan and Clapper all knew that once Flynn took the helm...as national security adviser, he would expose the Russia hoax," Jarrett stated. "And so they went after him with a vengeance. They targeted him, and they got rid of him."

In Michael Flynn case, Judge Sullivan's gross overreach turns justice into mob rule

Faced with no dispute between the parties, Sullivan decided to create a contested case by inviting in third parties to create a conflict and now is suggesting that he may substitute his own criminal charge rather than let Flynn walk free. In the past, I have publicly praised Sullivan. However, this is fast becoming a case of gross judicial overreach as the court appears to assume both judicial and executive powers. Sullivan can disagree with the exercise of prosecutorial discretion, but he cannot substitute his own judgment for it.

If Sullivan’s invitation for third parties to argue in a criminal case is unnerving, his suggestion that he might substitute a perjury charge is positively terrifying. Sullivan has compounded this judicial overreach by asking Gleeson to explore the issue, despite his public criticism of the administration's handling of the Flynn case. 

Under Sullivan’s theory, any time a defendant seeks such a dismissal (even with the support of the prosecutors) he could face a judicially mandated perjury charge. Faced with evidence of prosecutorial wrongdoing (which often arises after a trial), defense counsel (like myself) would have to warn clients that the court might just swap one crime for another.

Clearly this guy (can't call him a judge, judges don't behave this way) is willing to ruin his career and put himself in legal and financial jeopardy all because of his politically obsessive and vindictive animus aimed at Flynn and people in the Trump administration. 

 

Government power can't be used like this, these people need to to be taken down a few notches.

 

In any case, he won't win. The facts and discretion lies with Flynn and both sides agreeing to drop it. So, keep trying, buddy, dig up a retired judge to try and help you, try and use Flynn's old legal counsel, all for naught.

That is what is hard to understand, but I guess it is not surprising given the nature of the political elite.

Without the kind of psychological control they've exerted over people (facilitating the facade of choice) they have only their power to use, and use it they clearly will do. Pressure is mounting, and eyes are turning to people like Graham, Grassley, etc. who try to position themselves near Trump, but their actions make it obvious that they, as well, *are* the swamp Trump has been trying to drain. They're serving that political elite, hence why they fight doing whats necessary to clean house. That elite helped them get into power. 

 

They need to be attacked because right now all they're doing is paying lip service to justice, virtue signaling, hoping that things die down, but they fail to grasp the populist movement growing on both the left and right where people are getting tired of these d.bag elites.

I don't know why people on here and the Reddit Immigration sub don't think there are people that look at and post on both sites.... I mean I know the reddit immigration sub is pretty Liberal leaning to say the least but they at least need a counter balance to the massive amounts of BS that is posted there on a daily basis. I am going on my 3rd account just to be able to post on that sub after being blocked twice so far. The first one was my fault truly because that username was used for pure death and destruction to all things Democrat and Open borders. The second one wasn't my fault because I actually helped everyday people but I guess people don't like it when you talk the truth or have a different opinion than their own. The logic espoused here won't stand up in any actual court of law. The idea that the misconduct against Flynn has anything to do with Congress' oversight of Trump is just a joke, but Sullivan is finding some familiar friends in the effort to take down Trump and anyone around him.

I read the following story which was an analysis of Gleeson’s Brief he filed.  Neither this analysis nor Gleeson’s brief actually address the exculpatory evidence that has since come out.  It is really sad to see what was once thought of as impartial (politically) judges and former prosecutors jump down into the mud of political bias.
