Not the same. An EAD is not like an I-130. Anybody can expedite an EAD if they have a job offer. You can expedite an EAD with an offer from Walmart. An I-130 has much more involved in its process.

What would be a reason to expedite if someone got a job at Walmart?

I get really aggravated when people who are in the military suddenly think they are entitled to what civilians are not. Stop playing the 'my life is harder than yours' card. Military personnel and their families get THE best support you could imagine in this country. If you signed up to be in the military, you knew that deployments and PCS would be a part of that. As a military spouse, I know what I signed up for too.  I could go on and on. But I won't.

EAD is employment authorization. People apply for EAD while waiting for their permanent status is approved. So for example, if a person comes on a K1 and marries, and applies for AOS, their green card can take up to 8 or 9 months before it arrives. So not being able to work for 8/9 months can put a financial burden on many applicants. So in the meantime, a person can apply and interview for a job, and if they get an offer, they can send the offer to USCIS. The reasoning is that the EAD is a temporary authorization and the applicant will not miss out on employment because of the long process of the green card.

 

So most EAD expedites are approved with a job offer because it would be unfair to have people miss out on a job and possibly get into financial difficulty because the GC takes so long.

 

To summarize, an expedite of EAD is simply asking to temporarily work right away while your case is pending. An expedite of I-130 is to ask immigration to finish everything involved with immigration and issue permanent residency.

Yeah but if you are able to take advantage of the US immigration system, why not? Especially if the negative is zero, literally zero, you dont get your expedite, cool, you wait it out still.

At least for me, it was because somebody else actually needs it more. I had a similar opportunity (for a different reason) but I refused to play that card because I did not actually need it at the time.

For instance, I could probably get a handicap parking tag, but some old man or lady, or a disabled vet or something who actually needs it has preference - IMHO - over me as I am actually capable of doing a regular walk at this time. If that changes, I might push for it, but until then I won't play the medical card just because I could.
