I-130 expedite - military AD

Hi,

 

any active duty military petitioners here which tried to get their case expedite? If so, did it work and what reason have you used?

 

I’ve been dining mixed answers on this, just wanna know either there is any hope for trying to do so.

There is no harm in trying. It's free to do and most they can say is no. Look into the official reasons for expedition and see if your situation applies.

Yeah that’s what I thought. We’re planning on doing it in couple weeks, so it’s a month since we’ve received our NOA1.

If you are currently deployed to a war zone, that would allow you to expedite

Under what grounds would you expedite?  Serving in the military, in itself, is not a valid reason.......but it's free to apply.

I think that’s why I’m trying to pick peoples brains.. I’ve heard some people just put some decent letters from supervisor explaining that the airman could be deployed any time, that he suffers from stress affecting his active duty etc. 
 

We’re due to be PSCing this August to Japan, but due all covid stuff and movement ban we probably will be postponed. There is also a chance, due to medical reasons, we may have to go back stateside.

No harm in requesting an expedite.

If you're fishing for a need, I would expect is to have the same result as non-military people who fish for a reason.

Just being an active member in the military is not grounds for expedite. Many people seem to think so. Most approvals are based on conditions such as deployment orders or things like that.

We tried to expedite both our K1 and AOS because of my husband's deployment with no luck. War zone or no war zone, they didn't care. There are 4 specific categories that your expedition needs to fit it: 

• Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure to:
  1. File the benefit request or the expedite request in a reasonable time frame, or
  2. Respond to any requests for additional evidence in a reasonably timely manner;
• Urgent humanitarian reasons;
• Compelling U.S. government interests (such as urgent cases for the Department of Defense or DHS, or other public safety or national security interests); or
• Clear USCIS error.

If you can write your request the way it will fit in one of these with evidence, you can try it. We tried it based on his deployment orders and were denied.

Husband was deployed during our AOS. We didn't try to expedite but were told by the officer in the interview it was not grounds for expediting anyway. LOTS of people are in the military. LOTS of people get deployed every year. LOTS of us are military spouses. Its part of what you sign up for.

Are you on his orders? If not can you get added?

Why didn't you try? You can literally go onto the forum here and see that people get expedited just because their CO wrote a letter saying "There is a chance of Airman _____ deploying at anytime" and all that. They seem to be very lenient.
