hi

my mother  in law got immigrant visa from dhaka embassy in Jan. Now her visa will expire mid of june. I was wondering if new EO from trump will be any issue for entry, since she already got the immigrant visa.  Please please let me know

thanks

I would try to have her travel before the visa expires. To my knowledge, no new visa can be issued for her as long as the EO is in effect.

Quick points as I read...

  1. Impacts only immigrant visas. NIVs are not impacted.
  2. Does not impact anybody inside the US right now. Only people entering. AOS should not be impacted as a result.
  3. Does not impact existing visas.
  4. Existing, valid AP documents are still valid.
  5. Does not apply to LPRs
  6. Does not apply to any "physician, nurse, or other healthcare professional; to perform medical research or other research intended to combat the spread of COVID-19; or to perform work essential to combating, recovering from, or otherwise alleviating the effects of the COVID-19 outbreak, as determined by the Secretary of State, the Secretary of Homeland Security, or their respective designees;  and any spouse and unmarried children under 21 years old of any such alien who are accompanying or following to join the alien;"
  7. Does not impact EB-5 visas (an investment visa)
  8. Does not impact the spouse of a USC
  9. Does not impact children (under 21) of a USC, IR-4, or IH-4 visas
  10. Does not impact members or spouse or children of an active armed forces member

Edit:

It is active for 60 days unless extended.

Does not impact asylum or refugee cases (or other SI/SQ categories)

Effective as of 11:59 PM tomorrow (April 23rd)

If the visa expires, she will be subject to the bar before they can re-issue it.

She is good until June. You better makes sure she is here by then otherwise she won't be able to travel because the EO will apply to her then.

I'm not sure how to respond. The quoited thread includes the text of the EO and a link to it as well.

Specifically, section 2a of the EO:

Quote

Sec. 2.  Scope of Suspension and Limitation on Entry.

(a)  The suspension and limitation on entry pursuant to section 1 of this proclamation shall apply only to aliens who:

(i)    are outside the United States on the effective date of this proclamation;

(ii)   do not have an immigrant visa that is valid on the effective date of this proclamation; and

(iii)  do not have an official travel document other than a visa (such as a transportation letter, an appropriate boarding foil, or an advance parole document) that is valid on the effective date of this proclamation or issued on any date thereafter that permits him or her to travel to the United States and seek entry or admission.
