Can anyone tell us how to establish or what is required as far as paperwork for my step childs application for permanant residency to the United States?  My 10 year old stepson (I am a US citizen and the petitioner) of my husband ( a US Permanent resident) and I are in the process of applying for permanant residency for his son.   My husband was not married to his sons mother, they have no formal custody agreement, however she is in agreement for him to come here.  What type of form or custody agreement does the US require for this process? Thank you!

You’ll need to get that through Costa Rican authorities. If mother agrees for the child to immigrate the best would be a notarized letter from her stating that and listing child’s father and you as guardians - a local lawyer should be able to help on this matter. 
 

Don’r forget you’ll need this same form/letter/document when it’s time to get child’s US passport after naturalization so have several copies handy.
