An appeal would only makes sense if it was the fault of USCIS. If you can't prove that there is no sense in doing this.

 

You'll start from the beginning and file everything again. A new application. Follow the advices that people already gave you here. Read the guides, get the newest forms and read and follow the instructions carefully.

Yes, you're gonna have to send all the new forms, including the new I-944. That kind of stuff is not required for AOS Application. Only the marriage certificate is required.

But will happend with this old application ?

Will take me to court ?

No nothing will happen and nobody will take you to court. You're out of status right now but that doesn't mean that somebody will come and get you. Just file a new application and as soon as you get the new receive notice you'll be fine again.

Odds of them taking you to court are very, very slim.
