I would wait for the denial letter so you can what you did wrong. You visa is expired since the day you got in the country. The 90 days are to get married. There's not set timeline to apply for AOS. You're out of status, so start working on the new forms and evidences, and when you get the denial letter you can reapply

They will not knock on my door in the middle of the night to take me to dentation center ? 

Because im out of status.

99.99% that this is not happening. And when you file again, you will have authorized stay again.

AOS is not easy, but it can be DIY. You're gonna have to download the forms and instructions and read everything carefully.

What is 131 ? Petition ? 

We need new pettition ?

But that takes 7 months to get approwed ?

131 is Advance Parole, it allows you to travel outside the US while waiting for the green card.

 

You're gonna apply for AOS again. EAD and AP will take about 5 to 7 months. Green Card nobody knows it depends on where you live, but it can take from 1 months to 2 years.

Can you tell me what to put in new i485 form : 

Current status ( k1 expired)

I94 form ( expired)

Etc.

Not required, or usually even available for those adjusting from K-1.  We filed 9 days after our wedding, which was a total of 16 days after POE.  The ongoing relationship/financial documentation is for the AOS interview.

Hi there, I read through this entire thread and it seems pretty obvious that you didn’t really know what the AOS process is and how it works. I’m sorry you got a denial, However, I’m pretty sure they didn’t send an RFIE because there was simply too much stuff missing. It seems scary to you because you don’t have enough information so let me help you out a little: NO need to file within 90 days, the only requirement is to get married within 90 days, which you did, so you’re all good :) don’t worry you won’t get deported! However, you will have to reapply. There’s a really good guide on VJ to get you started. Please note: there is a new form that needs to be included as well (others in this thread mentioned it before)- your AOS application when done right will be A LOT of pages.. mine was 104 for example without any additional stuff that wasn’t explicitly needed. Read through the instructions and make an informed decision whether you or your husband can assemble a complete application or if you might want to get help from a lawyer. Or maybe you have a nice friend who is very good with paperwork? :) Anyways, I hope this helps. Again: no need to be scared, but you’ll have to put some work in this :)

Uncareful application compiling will end up in this situation. You keep copies of everything you sent, you don't even remember what you sent then DIY is not for you. Hire an immigration attorney or paralegal to help you with application or you will waste more money and time, USCIS will now deny straight up if crucial evidence / form is missing, they do have a memo for that.
