Hey folks, My mom has a SSN now but she got her immigrant visa and SSN in 2020 so she hasn't been in the US in 2019. Can she still file for 2019 taxes and get the relief package?

She can't file 2019 taxes. She will get the money in 2021 when she files 2020 taxes.

So the coronavirus relief package along will all other relief packages that could possibly be given will be reserved for her?

It's gonna show up as a tax credit when she files 2020 tax return.

Was she tax resident in 2019?

My brother filed 2019 taxes but he was a student at the time so he filed them as non-immigrant. But he's now an immigrant and an LPR. So if by tax resident you mean filing as an immigrant, no, neither my brother and my mother were.

Nope I mean was he Tax Resident, nothing to do with Immigration, IRS have their own definitions. So your Brother has a SSN back then? Seems like we have 3 different situations in one thread.

I just talked to his friend. He said that he filed 2019 taxes in February as an NR because he earned his 2019 income as an F1 ( He gets a monthly stipend from uni ). And that's why he isn't eligible for the relief package, according to his friend.

NR = Non resident? Did not think that was possible.

Yes nr is non resident. he now has residency but because the income he earned in 2019 was as a non-immigrant, he filed as a non-resident. idk if that's how it should be done or not tho.

I think he's trying to say he filed a 1040NR, instead of a regular 1040.

If your brother was expecting a stimulus now, he also won't get it since 1040NR are excluded. Next year he will get it.
