Hello everyone! I've been browsing around the WWW looking for an answer to my question regarding the recent order of President Trump regarding suspension of immigration to the US.

 

First off, I apologize if this has been discussed before. If it is, kindly guide me to that thread.

 

I am a Legal Permanent Resident since 2018 and here's my scenario:

 

  • I petitioned for my minor son (16 years old - currently still in the Philippines) and his immigrant visa was approved last February 2, 2020. Since he had to finish school, we deferred his travel to the US until school is over.
  • March 15 - the Philippines implemented an enhanced community quarantine (ECQ) due to the Covid-19 pandemic, airports were closed so travel was restricted. The ECQ was to take effect until April 15.
  • April  2020 - the ECQ was extended until April 30.
  • April 23 - President Trump issued an EO suspending entry of immigrants to the US.
  • April 30 - the Philippines again extended the community quarantine to May 15.

 

My son's immigrant visa is valid until June 26, 2020.

 

My question is: is he affected by the suspension based on the Executive Order? Will he be allowed to travel once the airports in the Philippines reopen?

 

I am hoping that I can get some answers/opinions from this forum.

When you say "blocked" from getting a new visa, is it not possible to request for a replacement visa? Say the quarantine in the Philippines is again extended until the end of June (his visa expired June 26).

 

Since the situation is beyond our control and that the airports are still closed hence, travel is restricted.

 

Sorry for all these questions, my wife and I are really stressed out due to this.

1) If the airports arent open then cant travel no matter what

2) If the airports open and his visa is still valid then he can travel

3) If the airports open and his visa is expired and the ban is in place, he would have to get a new visa from the embassy but they wont issue one due to the ban (he would also need to redo his medical)

4)if the airports open and his visa is expired and the ban is lifted, he would contact the embassy to get a new visa and redo his medical
