Apply for master degree program while waiting for the CR1 spouse visa (merged)

Hello Everyone,

 

My wife (in Taiwan) and I (US citizen) did submit our I-130 form in Jan 2020, it is under in-process status. Meanwhile my wife finds a English course program (~9 weeks) in US which she is very interested in, and it requires F-1 visa. Does she still eligible to apply for F-1 visa while our CR-1 is in process/review? How likely is it that US government will decline the F-1 visa application? Or will there be still any problem passing the US custom (entering US) even if the F1 visa is granted?

She is eligible to apply, if she gets a F1 then I doubt she will have issues at the PoE.

Shouldn't be an issue using an F-1. Getting (almost) any NIV while waiting for an I-130 from a spouse would be the challenge.

She probably will not get a student visa because there is a question in form says , IS THERE ANY ONE HAVE APPLIED AN IMMIGRATION FOR HIS/HER ? 

 

If you say No , its lie and if you say yes then hard to get student visa

Hello everyone, 

 

I submitted my wife (Taiwan)'s I130 from in 1/15/2020, and have started our waiting game. And my wife is very interested in couple master degree programs with universities in US. And those programs only have open enrollment once a year. We are thinking to apply start applying to the school in this Dec 2020, and the school start date should be at around Aug Sept 2021. Anyone knows that if the time we are waiting for the CR-1 spouse visa, is it possible my wife still apply for the student visa if her applicable (Master degree) gets accepted? Or where could get better/proper answer about that?

 

Don't want to waster another year for the school program.

The student visa may be iffy if she already has an I-130 in the works because it shows immigrant intent. There was a guy on VJ recently from France I believe who applied for a student visa while he was married to a USC and got rejected. (Can't remember where the thread was, otherwise I would link it)

 

Most likely if they suspect she is immigrating to the US due to a spouse they'll reject a student visa and tell her to wait for the CR-1. Also, applying for a student visa with the intent to adjust status and immigrate is actually immigration fraud. So there's that too.

A little tricky to answer.. I would advise against enrolling for any uni that she needs to physically attend regularly until her visa is in hand, we’ve been waiting since oct 2018 for our CR1 and only yesterday got DQ at NVC..

 

in saying this, I enrolled in a masters as a distance education student and completed it online, of course it will depend on the type of masters she wants to do, but there are a lot that can be done online without the need to physically attend school. 

 

Note, sometimes doing the masters online is the better option financially.. use the exchange rates to your advantage.. Uni Outside the US Is usually far cheaper than in the US
