Valid H1B applying for CR1 AOS

Hi guys, I was looking for cases similar to mine but couldn't find any. I wonder if anyone who went through a similar experience could help.

 

I'm on a valid H1B, living in the US, and married to a US citizen. We've filled for the I-130 online and now we're getting ready to file the I-485 AOS.

 

My question is regarding the options to file for the EAD and AP. Considering that my visa already allows me to work and re-enter the US, should I apply for these "just in case" (i.e. I get laid off)? Or should I do that only after the fact, if that happen? I would like to have the peace of mind of having this safety net but at the same time I don't want my case to take longer because of it.

If anyone went through the same thing, I would love to hear what was your approach!

10/05/20 - Received RFIE for missing I-944

10/06/20 - RFIE response sent to USCIS Lee's Summit's office through UPS
10/09/20 - USCIS received RFIE response
01/23/21 - Received Biometrics appointment notice

02/11/21 - Biometrics appointment (Code 3)

02/12/21 - Status changed to "Case Was Updated To Show Fingerprints Were Taken" (I-765)

02/17/21 - Status changed to "New Card Is Being Produced" (I-765)

02/17/21 - Status changed to "Case Was Approved" (I-765 & I-131)
02/22/21 - Status changed to "Case is Ready to Be Scheduled for An Interview" (I-485)

02/25/21 - Received combo card in the mail (Flagged as lost by USPS)

03/03/21 - Received combo card in the mail
08/16/21 - Status updated to "Interview Was Scheduled" (for Sep 14)
08/25/21 - Interview was cancelled

File for everything, AP, EAD, GC and I-864 and I-944.  Better safe than sorry.   It does not cost more for the EAD and AP when filed with GC.

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

As said, file for EAD/AP as well and it’s free. You having EAD in hand doesn’t affect your H1B status in any way, only using it does. Like you said, will be handy in case if H1B job loss.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

I am in the same situation as yours. I am getting ready to file everything as well. I would advise you to apply for all as its completely free. You dont can have the valid EAD and H1B status until they change your status to Green Card.
