Hello,

 

I understand there are numerous changes due to the pandemic.  My questions are as follows:

 

1.  My daughter and I were both abused.  Should I apply as the abused spouse or the parent of an abused child?

2. I would like to apply for consular processing while remaining in Canada.  Is the process completely shut down?

3.  My understanding is I have 2 years post divorce to complete this, is that accurate?

4.  Can you apply even if your spouse was not charged by presenting other evidence?

1. I am not sure, I think the odds are pretty much the same if you have evidence for both.. so I will leave this question to the experts on this forum. 

2. USCIS is still working bc I knew personally people who got their cases approved recently. They are just not open to public. 

3. Yes. 2 years.

4. Your spouse does not need to be charged, however you need adequate evidence to prove the abuse. if it's physical- police report/medical record etc. if it's mental- have you attended any therapy due to the abuse? any evaluation from your therapist. and of course, there is always your own affidavit, your friends/family's affidavits
