I really can't tell how this affects K1s currently not in the US considering there is an exception for spouses within the EO and when a K1 applies for AoS they are the spouse of a USC.

Or for K1s currently outside the US will they just no longer issue visas until the end of the ban considering the EO "will apply to foreign nationals seeking a green card who are outside the United States at the time of the order"?

How do other people interpret it?

I think the generaL consensus in this thread is that K1 visas are not in scope of the EO because it is not an immigrant visa, and so is not affected by the EO. So, there’s no need to look into whether k1s fit into one of the exceptions in section 2, because the whole EO in general doesn’t apply to K1s from the first place.

* Does not apply to LPRs

I am a lawful permanent resident currently inside of US.
I intend to travel to Canada over the weekend coming back on Monday.
Though my LPR status does not expires until May 2021, I have applied for renewal.
Does my pending application for renewal pose a problem on re-entry ?

Please note that I am no longer married to my USC wife, and my renewal of LPR is I751

Just want to add that even if your beneficiary's visa category is affected by this EO. Do not wait to file. File when you are ready. This EO does not prevent you from filing but from receiving green cards. Therefore it's good to get your applications in line. For parents of USCs for example, it typically takes about 1.5 years so don't wait on it. You can't predict the future but being on the reactive side for changes is a bad idea.

If I had my k1 visa interview March 13th (i still have not gotten my passport since it was a friday and the lockdown here started monday 16th), will the date on the visa  be the day of the interview or a later date when the embassy reopens?. Also should I expect it to be on its way to DHL or still at the embassy?. Thank you!

Gotcha, that makes sense.

Even if the K1 was in scope the wording indicates that it wouldn't be affected (I think/hope :D)

This must be SO anxious for you then.  I'm sorry you're in that point of the process.  I suspect the passport is still at the embassy... If DHL had it it would be on it's way to you.  I don't know if there is a way for you to contact them...I assume that there is no one at the embassy right now?  Maybe try and get a call into DOS somehow to ask the question?  My understanding of the validity is that the visa is issued with the expiry date which matches the validity date of your Medical Exam - Which I'm also lead to believe is 6 months from the medical exam.

Good luck!

You are an LPR. This EO will not apply to you in any way.

The issue date wlll be the date the visa is actually issued, not necessarily when you interviewed.

So if spouses of LPRs and parents of USCs are impacted by this EO preventing their entry to the US, does that also apply to I485? Can people come to the US first on a non-immigrant visa and then do I485 to get around?

It does not impact AOS, only visas.

I meant the issue date, just to make sure even if this EO affects those with a K1 visa, if the issue date on mine is the actual date i had the interview (March 13th) it wold make me a lot less anxious!.

Sadly CEAC says still "Ready for interview" which means they have not updated it, also the status on that other website where i scheduled my interview says "appointment" (apparently they have not updated it either)

Thanks for the answer.

Dear Sir/Madam:

Thank you for your email.

If your fiance's K visa had been issued before the new Presidential Proclamation took effect today, she can still use her valid K visa for travel to the United States.

Please note that the US Customs and Border Protection will make determination regarding visa holders' entry to the United States.  Please visit their website for more information: https://www.cbp.gov/travel
