She had absolutely no problem and it seemed way easier than anyone thought it was going to be. I also spoke to a few attorneys as well and can only speak on behalf of those with a k1 visa. From what it appears as long as you have the k1 visa before the EO took effect you should be safe. Also the airlines realize if they let someone in a flight and they get deported that airline has to pay a big fine so the idea for the most part is if they make it on the plane they should be fine. By the way her checked bag ironically got stolen in a very empty airport but I will trade a bag for my fiancée any day.

Hello everyone! 

I just want to ask, if there are people here with a valid immigrant visa (attached on your passport) who is a LPR spouse or child or other category but not mention on section 2 (b) of EO, intending to leave to US this week or for the prior weeks? Can you guys please update us if you would be able to enter at the POE? 

 

Few hours ago I watched a live video of a certain attorney and he said that even if we have a valid immigrant visa we cannot able to enter the US because our petitioner is LPR. 

 

PS: I attached a photo from travel state website (NVC) states that "no valid visa will be revoked under this Proclamation" 

 

But I don't know I am bothered and stressed what the lawyer just said, because my visa is just until August🤦‍♀️

That attorney is incorrect as the EO is clear: if you have an immigrant visa that was issued before the effective date of the proclamation you can use it to enter the US.

You are correct,  the attorney is wrong.   This is NOT retroactive

That is what we are saying/commenting on his live video. What is the purpose then that states on section 2 a, that we have a valid immigrant visa but we cannot enter because we are not mentioned under the section 2 B of the Executive Order. 

 

He said that if we aren't mention in section 2 B clearly states, we cannot enter even if we have a valid immigrant visa.

 

All along I thought the section 2 B are for people who will continue to process their interview and to received/issue a visa by the US consulate within the next 60 days, those people are the only entitled to get a visa and enter without any delay aside from the closure of the US consulate/embassy outside of US.

 

He also said in his post, just relax for now because if we try to enter, we might send back home or airport to airport.

How is this not important to the thread?

I saw the interview and I came away learning nothing new,  What did he confirm that is not already out there? I was hoping for more substance, but there was none.

 

Keep in mind the EO was written by White House Lawyers, these are the guys I'd like to see interviewed.

If he has the visa with passport in hand, the EO does not affect him.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I don't know if this question was raised but I was just wondering if K-1 fiance visa are included in the suspension of visas. I am just waiting for our embassy to open and the quarantine to be lifted for me to schedule an interview. Thanks
