I'm not sure how it couldn't be true...it's the text from the EO signed by the POTUS. Those 3 criteria are not really ambiguous.

 

I get the consulates not wanting to say something until they have guidance. That's a typical CYA process.

They would need guidance from DOS, not DHS. The consulates are not under DHS.

Hi guys, 

 

Was hoping someone would be able to help us. My fiance and I have essentially finished compiling our K-1 folder (couple odd things left to do), and were hoping to submit very soon - however, with this EO and the virus, it's thrown everything all over the place. I'm currently with him in USA on the ESTA (my flights have been cancelled so far), we're really considering getting married now and adjusting status (totally aware of the issues with this/the grey areas, hence we're worried about this route too!), filing the relevant spousal visa paperwork. It's a terrifying reality going back home and being in all of these unknowns regarding immigration, in addition to not knowing when we'll even see each other again - hence our considering of getting married now. If anyone is able to offer some advice, that would be really helpful - we do plan on consulting a lawyer too.

I hope they get this guidance very soon. They are denying IV holders from direct US flights according to the EO.

I wouldn't dwell on legal ramifications. Your circumstances changed during your trip significantly, AOS under VWP is allowed as long as your intention was not to come and stay permanently which it is not the case here.

 

Your intention was determined at your initial POE so you are okay on that too.

They should not be denying any valid visa holders, both because 1) valid visas are not covered by this EO, and 2) the EO is not into effect until midnight tonight.

 

It's possible airlines are doing so, but nothing the US can do about that. They are private companies and/or foreign governments.
